That sucks.

How did you deposit it? Paper check or electronically?

 

Paper cashiers check. The depositing bank said it was as good as cash and could not be touched

 

Did you follow-up and see who authorized the withdrawal? You may have a civil and criminal complaint against that bank for an unauthorized transaction. And grounds to get that money back. Spending probably isn't what you want to do right now, but a lawyer may be a good idea right now. Get the records from both banks and see what they did.

 

If your BB&T account isn’t “negative” anymore my guess would be that BB&T canceled the Cashiers Check. It can only be done in specific circumstances. So no one “withdrew” it, it just didn’t transfer when deposited.

The process is
1) Deposit Check into FI-1
2) FI-1 can legally “hold” a portion/all of the funds or ,on good faith, give you access to all the funds (even though they haven’t actually received the funds yet).
3) FI-1 sends request to Fed. Reserve
4) Fed. Reserve sends request to FI-2 (BB&T)
5) BB&T says “we’ve canceled it and aren’t paying” to the Fed.
6) Fed. Relays that to FI-1 and since FI-1 didn’t receive the money, they cant give it to you. Essentially the check didn’t clear.

If BB&T canceled it, my guess is someone goofed up (cashier that gave it to you/signed the check originally). If the branch is giving you the run around, I’d ask to talk to the regional level or higher management. You’re doing this to make sure everyone is aware of what’s going on and ensure the branch isn’t trying to hide anything. I would make a pretty big ruckus if my bank canceled a cashiers check.

 

I’ll try to call someone else on Monday. I filed a complaint with the FDIC and timelined the events for them. Thank you JT

 

I didn’t think about that but it’s a solid move. I’d also file a complaint with the CFPB (consumer financial protection bureau). The insurance agency’s (NCUA/FDIC) are important but you’ll probably get more traction with the CFPB as it’s there sole job to protect consumers.

What?! That’s freaking sweet! (Or maybe I’m just weird). I’ve only heard good things from employees I know that work there.

 

She really likes it. Really good agency. It was a little rough under Trump as his cronies tried to run everyone off, but things are much better now.

She said to file a complaint because it would force them to answer questions, but there wasn't anything they could do as far as enforcing because they're more for mass bad stuff.

 

I forgot about holds on a bank check.

 

It varies but if it’s a cashiers/bank check they can normally only hold it for 1 day…. As a side note this is why fraudsters often use bank checks, the bank “releases” funds they don’t have because us consumers would be pissed if they didn’t give us our money.
Just because it’s says “certified”/“cashiers” doesn’t mean it can’t be canceled or isn’t fake.

@3pooches, Tiffany and I were just trying to remember the last time we stayed home all weekend… it was a while ago. We we’re recalling the last half of 2021, and y'all's name came up like 5 different weekends hah. I vote it stays that way in 2022.
