I've been tossing around the idea of making a Children's book about Toyota trucks. You think Toyota would sue me into oblivion?

make it a generic but styled truck

Like most things of this nature, its usually OK until it isn't - if it blows up and goes viral and/or starts making you considerable money, you can bet Toyota's lawyers will come calling.

it would most likely be a cease and desist order, or if it had already made you a millionaire then they'd probably come for a payday lol.

 

Most brands don't like the idea of you making money off their product unless they get a cut

 

Which I have to agree with overall. In this day and age where it's so easy to produce content/share media it's so easy to rip off other people's ideas or work, most of the time people don't even know they're doing it because its so easy.

I had a photo business teacher in college that took an iconic portrait of Miles Davis back in the 80s, and American Airlines ended up using it in an advertisement without his permission. Because he had gone through the copyright process with the image, he was able to successfully sue them and got a shit ton of money out of it. So it does go both ways, though these days it would probably be harder to go after a big corp like that.
