    Unless there was an employee or traffic control directing traffic and you ignored it, safety on the yard isn't your responsibility. So they're right to not fight it.

    Just because a customer is allowed in an area does not instantly make them fully responsible for their own safety. That's why industrial businesses have safety training for their staff -- to keep everyone safe.

    The layout of the yard seems built for hazard and they seem aware of that fact.

    All I stated was that with some situational awareness and caution around heavy equipment this all could of been avoided. Glad they are making it right without grief.

    There are signs everywhere saying no cell phones in the yard; I thought this was because they didn't want people taking pictures to scope it out for robbery, but honestly I don't know at this point. All I know is that I took out my iPhone to take pictures for insurance purposes (and to post on TW :D) and was met with absolutely no protest.

    I wonder how well that'd hold up if challenged though.

    Sure there's a sign, but does it carry the force of law? Anyone can put anything on a sign, doesn't make it "true."

    I see dump trucks with "not responsible for falling cargo" signs on the back; My dad tells me this is bullshit to keep people from tailgating, and that they really would be liable.

    As stated above, they just want to scare people into being more careful; I know a couple of really good lawyers who could make things very unpleasant for this place.

    That's the right move. Your insurance is liable unless they make the yard's insurance liable, which motivates them to fight on your behalf. Much better than going it alone.

    This happened in October 2015, a few days before Halloween. I was working two jobs at the time, barbacking at nightclub as my primary job and delivering pizzas on the side.

    It was 9pm and my shift at the pizza place was over; I had to pee, but the bathroom was occupied. The bar where I also worked was within walking distance, but it was pouring rain, so I obviously drove.

    I came to a 3-way intersections with stop signs. I looked both ways and saw the intersection to be clear, so I proceeded to make a left turn from the one-way street I was on (Oakland Avenue) onto a 2-way street (Pine Street). That is when I noticed a silver 2002 Mercedes E320 sitting there, to my left; I believe that the guy in the Mercedes had gotten there first, but that he had zoned out behind the wheel or possibly passed out.

    My belief is that he saw me making the left turn, and decided to enforce right of way; Unfortunately he was hammered, so he didn't have the best hand eye coordination. I believe he tried to "thread the needle" between my truck to his left and the curb to his right, but he floored it too early and ended up slamming into the left rear corner of my truck, almost taking my rear bumper with him...
