Thats not the business page...its not Explore Overland. It was started by the business but has been "taken over" by the members I guess and they are looking for new moderators ect.

It's pretty heavily EO branded for not being an EO company page.

Yes, it was started by EO, but isn't the business page.
I'm sure that I'll get flamed for this, but I'm much more in the camp of the business was not managed well (and that seems to be a bit of an understatement, but you get the point by me stating it that way) than the camp of the people running the business were out to screw everyone.

I'm in the camp of intent doesn't matter, the end result does. They didn't set out to swindle tens of thousands of dollars from customers, but they did. They easily could have been transparent and temporarily stopped taking orders when they were overwhelmed. They could have stopped organizing these adventure-fests and spent the time in the shop producing products.

What you're saying is like homicide Vs. manslaughter. "It was an accident, I didn't mean to kill him." well, sure, but he's still dead, you still go to jail.

Same. Obviously doesn't help all the folks screwed (or potentially screwed) out of their money which sucks. Still, I dont believe EO is on the level of Pelfreybilt. Maybe my mind will change later if more details come to light though.

I spoke to VJ about this page and he removed all existing affiliation to EO last night. Previously this page had Derrick's Cell Phone number on it and a website link directly to EO. Currently, it only has the previous posts that were made by EO, with the last one being 6 months ago. This is the past, knowing that a new leaf was turned on 5/17 is all that matters going forward.

To back this up even further, at the start of the month, EO had updated their anticipated lead times on their website. WHAT HE SHOULD HAVE DONE was had the respect, honor, and integrity to make an update saying "Hey we are ceasing new orders, we have hit a demand that clashes hard with supply, if Your orders are in we are going to try to fulfill them the best we can, if you are going to place an order, wait until we are ready to do so again."

Instead, with your fab team all gone, and just the business personnel left, and [most likely] knowing that the end was near, he lied.

And sentences for those 2 different things are drastically different.
Yes, intent matters. It's mattered since people spoke Latin. Mens Rea is a thing.

IF I was the person out nearly 20k, intent would not matter to me at that point...

So what amount of money do you have to be out to make intent matter or not matter? Is the number $20k? $5k? $1k?

I think we're losing sight of the point here. We're not looking at manslaughter vs murder here. We're looking at financial contracts. Intent doesn't matter. I think thats why Mr. 20k down the hole guy keeps his friends and business relationships separate.

I agree. If they closed up shop, I don’t think it was planned out that way.
I truthfully hope they are doing OK. I had a blast at their Overland Festival, met a lot of good people. But I also hope I can get my money back.

The guy is a complete low life anyone who is trying to defend him please stop. For what reasons he decided to start de-frauding people is of no importance. He aggressively pursued orders that had no chance of being delivered in any reasonable time period (probably ever) and then ghosted the people who placed said orders. From the posts written on this thread I don't think anyone who ordered anything December 2021 or later ever received it. He was in hot water and collecting money to keep his business afloat, the definition of a ponzi scheme. He clearly knew exactly what he was doing courting people for big sales and ghosting everyone else. Unfortunately in these situations the one thing that never happens is they come clean and just admit the truth. He must have spent every dollar of peoples orders on other business or personal expenses and had no choice but to disappear like a coward.

Maybe one of the fine folks that recently joined here, and were previous employees, can extend an invitation to this wonderful free site for them to come and give their side of the story. Big doubt though.
