    If the story is true it certainly doesn't seem like he's hiding from anyone. He's talked to the bank, the police, the local DA, the DMV, and hired an investigator.

    But did he talk with his insurance company? Did he have insurance?

    One other thing… if the loan company received insurance money for the truck, then they should sign over the title to the OP.

    This is also why you should buy/sell used vehicles at the tax office.

    Yeah.
    I started reading the thread thinking it was new, only to realize it was a few years old.

    Some things are just not worth the time or expense to pursue. Obviously whoever is holding the title is playing the waiting game as well. This truck may remain in purgatory for a while, but whoever is holding the title may eventually decide they have waited long enough. Wonder if you could do a title search or VIN search and figure out if the title has changed hands. They could likely sell it off to some kind of recovery company for pennies on the dollar, or maybe already have.

    OP, it sounds like you’ve vetted your options and are dealing with mitigating your losses as best as you can — and that the truck is still in limbo right now, in storage.

    Thanks for sharing your story to this point. I appreciate your courage and tenacity. I wonder if the DMV has a path that you can follow or it would at least it would be interesting to vet that avenue a bit more, see if there is some paper they can push. I’d also be curious about informing anyone who is stonewalling you, and may try to repossess — call them out on that and start building a paper trail to recoup your storage costs, if that ends up being your only option. Look into the repo process and see what your legal options are there to leverage that. You still have possession, think about what the other parties will do and see if you have any other chess pieces to move.

    I’m pretty sure if the OP didn’t have insurance on the VIN at the time of his transaction, he’s screwed.

    I don’t see Capital One releasing the title.

    OP, you’re in a fight. Some of the bystanders have nothing but telling you you’re screwed. Don’t give up. Use anything you’ve got that’s legit. Be careful, but make it hard and bloody their nose if you can.

    Yeah.
    The scammer has/had the OP's money. The original seller has the bank's money. The bank has the real title. I doubt the scammer has the money to return, and the bank isn't going to pay twice for the truck. Who is going to court? The bank has the most likely successful outcome in forcing the OP to return the truck. The bank owns the truck legally. That leaves the OP pursuing the scammer for return of the money he was scammed out of. The bank is likely just waiting things out -- too expensive to pay some lawyers to pursue return of the truck, and the OP can't use it.
