2008 Rear Ended - Thoughts?

    I was stopped in a construction zone a few days ago when a woman decided to text while driving and rammed me at about 40mph. The bumper is bent in and the tailgate damaged. It appears the trailer hitch is up in the spare tire as well. The entire bed it shifted up towards the cab. I got a bad concussion out of this and haven't been able to get under the truck to look for damage. What do you guys think about the possibility the frame has been bent? I'm hoping it won't be totaled and can be fixed but am having some doubts due the speed and how her little car went under the bumper. Photos attached. Also, will the entire truck need painted to get it all to match?

    Trucks are designed to be rear ended, they will fix that for sure, no frame damage, or very little if there is any. Hope you feel ok these next few days.

    I'm sorry to say but if your hitch is bent, it most likely bent the frame since that's what it's attached too and if my memory serves me well I believe the hitch assembly is stronger than the frame in the rear. I believe there is a crumple zone back there but I could be wrong. Anything is fixable but not sure if insurance will want to pay for that or not.

    The hitch pointing down means the frame is bent. There will be a sharp kink in the frame rails where the hitch brackets attach. The area around the bumpstop strike pad will be bent up - that's the crumple zone. Bed may be cracked inside as well. Being a 15 year-old truck, insurance will likely total it.

    Guys, a few additional questions I'd like to get your opinions on. If the truck can in fact be repaired, would they have to paint the entire vehicle in order for everything to match? In the 15 years I've owned the truck, the paint has certainly gotten "lighter" than from when I brought it home. It also sits out in the weather and has for 15 years. I'm pretty sure if it can be repaired, there will be some painting involved in the back end - probably a new bumper, tailgate, and the bed. If the thing can be fixed, it would be nice having a paint job that matches front to back.

    I'm still waiting on the friggin police to finish the accident report so it can be turned in to my insurance and they can pursue the other drivers company for the repairs.

    I tried getting down to look at the frame today but with this concussion, I can't do it. I did see that the front of the bed, up near the cab, on both lower sides, it's almost bent into the cab on the bottom. The gap is pretty big up top.

    I was just wanting some thoughts on the paint and, if it can be fixed, if I could get the body shop to write up a complete paint job.

    Thanks, fellas. Start concussion therapy tomorrow and really hope it works. I've been in a fog for over a week now with pounding headaches and ringing in the ears.

    It’s nearly impossible to 100% match paint a vehicle. Especially when the paint is sun faded. If you want a 100% perfect match, then the whole truck would have to be painted.

    Which if the rest of the truck is not damaged, why would the insurance pay for it to be painted? If they deem it not totaled, they will match the paint the best they can on the damaged parts, do some blending, send you on your way.

    On an older truck, it’s not the hugest of deals. But if you are very specific, it will probably be noticeable.

    But, from what I’ve seen on here, it seems like damage such as yours is getting totaled out.

    Hope your head gets to feeling better. Talk to your insurance about the following things

    • your doctor visit bills
    • Pain and suffering
    • Diminished value due to accident. (you can no longer sell your vehicle at the price you had because it has been in an accident. Insurance will pay you the diminished value).

    As other have already said, the hitch being bent down and in and the bed to cab gap being different from top to bottom are generally signs of a bent frame. That said, anything can be fixed. The big question is for how much.

    As for the paint, in order to properly match the paint, they'll have to paint a lot more than just the spots where the paint is damaged due to age and fading - and that adds cost to the repairs. That's where your insurance company will decide if they want to total it or not.

    Remember, even if they total it, you can buy the truck back from them and have it fixed yourself. The problem this creates is that you end up with what's called a "Salvage Title." If you plan on driving the truck into the ground and never selling it, this isn't a problem. If you do ever decide to sell it, a Salvage Title automatically makes the vehicle worth less.

    Getting back to if the insurance company totals it, remember, used car prices are through the roof. This means your Tacoma is generally worth more as parts than as a complete (but damaged) truck. Whatever her insurance company first offers you, don't accept it. You can and should negotiate with them to get the value up. They will always, always, always low ball you with the first offer.

    Thanks, all, for the replies and assistance. I have hired an attorney and have been seeing doctors for this concussion. I actually begin therapy today for the concussion.

    I am a resident of Pennsylvania with the "limited tort" option on my insurance (changed it already to full tort). The only way to recover for P&S is to have what they call a severe brain injury (TBI) which a concussion is linked to. I have to try for something as things are just not right with how I feel.

    My Tacoma, from what I'm seeing, is only blue booked at around $19k. It only has 30,000 miles on it and is a 2008. I did a lot of traveling for work over the years so the Tacoma did sit quite a bit. You can imagine that it is in showroom condition. I believe it's worth more than $19k and will ask for $25k to settle if totaled. I'm in no rush to accept a settlement and am willing to wait it out to maximize what I want. Wouldn't it be nice if I was told to go pick out the Tacoma I want as a replacement! Hey, it's nice to dream, right?

    X2 , if it is totaled, due ur diligence to find comparables, not many gen 2's in our area. I went to Ohio to get my 13.

    Its totalled.

    Was rear ended and had similar damage to yours. The hitch and bumper weren't as bent as much as yours through. Due to the age, insurance won't replace the frame cause they're on backorder and it would cost too much in car rental as well. AND, that's not accounting for any other damage they'll find along the way.

    To give you an idea, mine was a 2010 DCLB TRD Sport with 104,000 miles and I got $21,000 for it back in June when they totalled it.

    The lady that hit me was uninsured too. Thankfully I had uninsured motorist coverage

    TexasWhiteIce, bro, I feel for you! I drove mine yesterday to get gas so it wouldn't freeze up in the cold weather and it seemed to drive okay. Not sure if it's tracking sideways or not. It's been sitting in the driveway since the accident waiting on the friggin police to get the damn accident report done! I was messed up after the hit and forgot to get the bitches insurance info or witness names! Hopefully the cop did but I won't hold my breath! I already have an attorney standing by as I received a bad concussion and have been going to PT for it.

    I'm planning to have an independent guy come out to examine the truck and give me a private estimate so I have an idea where this is going.

    I tboned an elderly red light runner at about 45 & totaled my Nissan pickup. A couple mistakes I made.

    I didn’t keep good track of what I paid out and what I got reimbursed for. The ambulance bill came much later and I had to eat that.

    It sat in an impound lot for a long time, luckily the insurance covered it.

    Staying on top of the whole disability thing with work and getting the hospital to send necessary paperwork was practically a full time job. Hospitals don’t give a crap when you need something from them that doesn’t make them money. Several times I had to pay an office visit fee to get them to respond and fill out some paperwork.

    Be carefully about the pain meds. During my rehab time I watched some documentary this drug will kill you. So I was aware of the dangers. Then the way it was dispersed, a few at a time repeatedly. Then as I was approaching not needing it anymore they gave me like 30 pills. If that’s how they do everyone, I can see how easily people have a problem with it.
