Haha at least I didn't total it! It was close to it, but no airbag deployed or crumple zones so they fixed it. Worked out okay as the car only had 48K and was 5 years old at the time. I got 5 more years and up to 115K without any real issues except the water pump, no complaints.

The issue is that MA since 1995 or 96 considers any DUI to be a crime of violence no matter what.

The DUI underage takes almost nothing re alcohol consumption, as a minor is not legally allowed to drink in the first place. Here I believe it is .02 to be considered legally drunk as a minor versus .08 if you are 21 or over.

The interlock system is sometimes overly sensitive..not even just the obvious stuff. There's a huge list but off my head:

Menthol cigarettes
Marinades using alcohol
Mouthwash
Some toothpastes

I know there are more but that's just off my skull.

So drinking the night prior, especially heavily, doesn't shock me that it tripped the system. MA limit is .02 for that and I would reckon the same there.

I know my brother in law has had the Intoxalock since 2016 and a couple of times it's given a false positive. One time the machine was faulty for sure, he brought it immediately to the calibration facility and it was determined as such and replaced. Another time I'm not sure what happened, but he hadn't had any alcohol or things on the list and called immediately. He was instructed to drink a glass of water and go do it again, at which point he got zeroes (which is ideal).

Re your coworker, not sure what the limit on priors is. Here it was 10 years until 2002-3, at which point Melanie's Law instituted a lot of changes..one was lifetime lookback. To be habitual offender I wonder if he didn't have other traffic infractions as well..

I'd honestly guess about a thousand. Which I'm not proud of one bit.

Though I remember reading a statistic about it saying you probably get away with it a thousand times before getting caught.

It doesn’t take much to be considered violent.

get it bumped to “especially aggravated” and you’re screwed.

Violent offender means nothing to me.
It’s a BS charge. It’s just there to impose more penalties.

Sometimes it is yes. Others, such as my case, I submit it was not violent.
