    The bump stock issue isn't comparible to the SBR issue. I would be hesitant to use the former to predict the outcome of the latter.

    Yup its dump. I know some people toss all their firearms into their trust but I dont. My non-NFA stuff isnt in the trust just so i dont have to deal with getting it notarized every couple weeks. the ATF really should have provided info on that ahead of time or allowed a grace period. But thats a separate issue.

    Not exactly. It’s not apples to apples but the main takeaway from the bump stock case is that the judge ruled that the ATF does not have the power to make or change laws. That very much applies to this new pistol brace ruling as well and I’m sure all subsequent lawsuits will be referring to it.

    Yup I bet they didn't put that part in the proposed rule because they knew that's exactly what people would do so they could register as trust.

    Much like you my non NFA stuff is not in trust. My main concern around individual is my wife and times I'm not at home

    Ugh that’s what I was afraid of with trusts. I hate to admit it but I think I’d rather pay the $200 to put it on my trust than get the free stamp.

    For the sake of my own homework where’d you pull that info from? I haven’t had time to read though all 300 pages of the new rule which is my usual approach with new regulations.

    It makes my wife sleep way better at night knowing that she doesn’t have to worry about it and that if something happens to me my friends that are much more gun savvy than her can help her and take possession of NFA items while she figures shit out.

    Was a pop up on the eforms site if you select the trust option for registration

    I'm gonna wait it out a little bit my plan was to SBR this one anyway and for the same reasons I much prefer trust option

    Machine guns are defined in the NFA. You can't change (add to) the definition of a machine gun without changing the NFA (*congressional action*). Hell, even Diane Feinstein admitted that when she was trying to amend the NFA.

    Pistol braces aren't being banned, and nothing is being changed with regard to the definition of what an SBR is/was/will be.

    Is the ATF circling back on their 2012 pistol brace determinations? You Betcha! But that's no different than what they did with the solvent traps and cups we could buy on Ebay. Or trusts and 41F. Or 80% stuff.... ETC!

    I'm not a pessimist but I can usually see the writing on the wall for these types of things. Every time we start flying too close to the sun, we're going to get singed.

    Well said and touché. Great point with the solvent traps.

    Bottom line is no one will know till there is a judge’s interpretation. And then that will get appealed and reinterpreted several additional times until we probably hear from the Supreme Court.

    True but after publishment vendors will only have 60 days to have all that recistered I’m not talking about just the braces

    From what I gathered albeit none of this is clear, any new purchases post publishment will have to be registered first like buying a suppressor but I may be mistaken

    All you have to do is fill out Form 5s for each item and file them with your estate stuff. Unless you have machine guns, NFA stuff is mostly worthless to the inheritor anyway. Not worth the hassle of a trust. Smash it all with a sledge hammer and throw it in the garbage.

    I know that but she doesn’t. It’s more a matter of simplicity for her sake. Plus The longer I’m alive the longer my wife’s I’d keep this or that list grows (which I love and appreciate).

    She’s says I’d keep the AK (her absolute favorite) but then she says I’d keep the .22s too and then oh I guess should keep the .22 suppressors too if I’m keeping the guns. And then maybe the rest of the handguns too… And the then the list keeps growing.

    I’d rather everything be her property for her to disburse to my friends as she feels appropriate opposed to her having to fill out forms she doesn’t even knows exists. She likes guns but isn’t on the level to know what form to fill out if this or that that happens.

    Bottom line a trust works better for me and my family even if I have to begrudgingly pay for tax stamps

    Sure she can say eff it and trash my NFA items but I’d rather people I care about be able to take possession of them and keep enjoying them opposed to the ATF destroying it after I already paid the taxes on it in the first place.

    Edit im assuming youre asking if you can possess an AR pistol with no brace just a bare buffer tube.

    Maybe maybe not
    ATF is looking at other criteria in addition to the brace including overall size/weight and other attachments including optics
