It took just over 4 years to have bump stocks determined as not machine guns after the ATF said they were.... I would like to be optimistic and say it might be faster this time but Im not holding my breath.

 

Fair point. Plus, given what NY is doing.
The gun industry and tax payers keep getting left with hefty legal fees while any whim of a gun control law gets thrown in with no cost to those who put it forward.

So with this brace ban I just learned about, how do I go about buying the AR pistol I wanted?

Buy it and then call your state representatives and tell them to do their job and not for the ATF to illegally and illegitimately enact law.

 

I'll buy it with out the brace. Maybe try and find somebody selling one somehow. Then just file for an sbr tax stamp, then run a stock lol

 

Buy it with the brace. The new ruling doesn’t ban the possession of braces but instead reclassifies braced pistols as SBRs. Still 100% legal to buy and own braces.

Then you can either do an amnesty SBR registration or wait and see what plays out in court. This is pretty much guaranteed to be tied up in court for years. Also a good chance it’ll get thrown out based on the recent bump stock ruling where the judge said that the ATF is a law enforcement agency and doesn’t have the power to change or create new rules.

Personally I’m going to wait and see what happens. The free amnesty registration is only if you file as an individual and I would much rather have any SBRs on my NFA trust.

 

Fair. What's (I'll Google it) the benefit of an NFA trust. I had 4 guns before I lost them all in a tragic cattle herding accident

 

You can add friends and family members to the trust so they can also use/have access to your NFA items. Also allows them to skip additional red tape to keep your stuff after you die. In my case it’s because I prefer if my wife has full access to the gun safe without having to lock up NFA items separately. Just easier in my case.

I only put NFA items on the trust.

 

I believe the trust can apply for the amnesty stamp as long as it had possession of the firearms before last Friday (rule release date). However this ridiculous ruling was written as badly as 114 so I'm going to give it a couple weeks to see what consensus comes to be. I could be talked into free stamps. I'm already on that list...

 

you are correct. Also turns out there was an error on the eforms site and you actually have until the day the new rule hits the national register. When that will be nobody knows.

I’m taking my amendment to the bank tomorrow to get notarized. Worst case I put a few pistols on my trust and don’t have to amnesty register them but nice to have the option.

 

Might consider contacting our Senators to remind them to do their job.

did you read through the brace ruling at all? At the end of each section they addressed the public comments on the specific topic and broke it down between number of form letters and unique responses pretty much dismissing the form letters as meaningless.

Paraphrasing their responses they’d say we got 35,000 comments on this, 31,000 of which were form letters. Of the remaining 4,000 comments they said this. Made it pretty clear the form letters went straight in the trash.

I’m all about writing your representatives but try to actually write a letter instead of print, sign, and mail a pre written one. They don’t hold nearly as much weight as a unique/personal response.

 

I think that sums up how anti thinking the ATF is.
I typically write my own thoughts. But this time, the letter was way better at articulating some of the insanity of the ruling that I used it.

 

Bought a lower, my friend convinced me to just build one.
