I just want some sense of consequence but you're right that it isn't worth the effort.

I drive pretty cautiously these days out of fear of what some careless uninsured dumba$$ may do

yeah it’s unfortunate for a lot of safe drivers that insurance is a shared risk. i used to self insure.

If she's in MD, you 100% must have insurance on a vehicle while it's registered, your insurance is required to notify MVA if you cancel liability coverage. Things I know because when I used to have USAA & was in the military (MD tags but not MD policy as I lived elsewhere) USAA would religiously inform MVA that I "canceled" my policy on my renewal date, but never did inform them of the "new policy" that they renewed. Every 6 months, I'd get a nastygram from MVA telling me I owed MAIF (state... policy for shitty/uninsured drivers? Not sure exactly what it is.) eleventybillion dollars for "driving uninsured" then had to duke it out with USAA & MVA.

They also went after my uncle years ago, he had a dilapidated old POS he never drove, and didn't turn in the tags before not renewing the policy. They made him do something ridiculous like get a notarized statement from his neighbor stating that they hadn't seen the car move in X time period.

Aaaaaand yet, this lady still was driving uninsured (assuming she had the car tagged in MD) and if I had to guess, OP will somehow get little or no benefit from all those systems those systems put in place.

You carry California Insurance? Check to see if you have "Uninsured Motorist Property Damage" or "UMPD" on your policy. If you do, and it's determined the other driver or vehicle was Uninsured, your Deductible is Waived. If not, get a Lawyer. This coverage IS NOT the same as "Uninsured Motorist" coverage, that is for Medical Bills. (This from an Insurance Agent of 10 years in California) This is a no fault accident (On your part). Your Insurance Premiums should not go up if you go thru your policy for repairs, which I suggest you do.

If the police ran her tags which they should have if they came out for the accident. They should have been notified, took her plates and impounded the car.

On 3, I agree it's more likely than not going to have little short term gain but things can change.

Or if perhaps that person wins a prize in the lottery that has to be redeemed at the lottery, it could be attached for instance. Not likely but something if so.

And yes, especially when things like this happen. That especially sucks in your situation..or my mother who was put in the hospital by someone with no license or insurance.

As the person who injured my mother should have been arrested but wasn't. Bullshit.

No injuries I'd let the insurance handle it, as long as the other party is taking responsibility. If they are going to fight you on it, then lawyer up.

    Well,

small update of sorts… followed up with insurance co. Was told that theyre waiting for a return call from the other driver to provide her current insurance info.

I asked about other scenarios and was told that I can can use my collision coverage and pay $500 deductible but cant guarantee that my rate wont go up. Was also told if the driver turns out to not have insurance i can use my uninsured motorist coverage and the deductible is only $250. I guess at this point $250 is better than $500 but im gonna hold out another week to see if they hear back from the other driver.

Good for you. I was lucky and my Insurance Company waived the deductible entirely even though the other party at fault was determined to have Insurance. The other company jerked me around when I submitted the claim to them directly so I then went to my company for repairs. Once it's documented the other party did or did not have Insurance Coverage I doubt you will see an increase in your rates. If your Insurance company whacks you with even a $250 deductible they may or may not go after the other carrier to recoup your deductible (Subrogation) If they don't get it back for you, you can always take the other party to Small Claims court.

    Updates:

    - The other party does have insurance through Maryland Auto Fund, basically state managed insurance for those who might be uninsurable through other carriers. Spoke to their adjuster today and they are accepting liability and funding repairs + rental car. I was told i can take it to the shop of my choice for repairs. They did a visual estimate based on photos but did state they knew the costs would increase for possible unseen damage.

Take their repair quote as a starting point. My wife's Tesla got the rear bumper scuffed by another driver and the final repair bill came out to be almost twice the original estimate based on the photos I submitted as per the process.
Now you get to choose a shop you trust to do the work correctly and in a timely manner.
