FWIW: if ordered w/ the rack, that'd have been a port install, not factory. Suspect that's contract work. If installed at dealer then it's not coordinate/factory issue, it's a dealer issue that OP has to convince corporate of (likely "easier", imo).

Have you tried taking it to a detailer and had them work their magic?

If you're thinking there's some other manufacturer that buys cars back under this same set of circumstances? I don't think there is.

Toyota is doing what it’s supposed to do, fix the vehicle. It is up to YOU to pursue any “lemon law” avenues as they are not bound or obligated to provide you your money back. When I was in Cali, I had 2 Honda Passports a 2020, and 2021 and both had severe problems, one had reoccurring actuator issues which when I pursued the “lemon law” Honda Corporate contacted me and provided a direct replacement from the dealer for a 2021. I got the 2021 and immediately had some electrical issues and decided to sell it to shift.com within 1 month and ended up getting more than I originally paid for the 2020. Took the cash and bought a 2022 Subaru Outback which I love. I also own 2 Tacomas. 2022 Sport and a 2023 OR which we absolutely love and have been bullet proof……my 2 cents!!

Yes I am currently perusing action, unfortunately its a very very slow system, lawyers and court systems can sometimes take years which I'm currently waiting on. I'm just really pissed at the moment. Thanks

Depending on your states laws it can be tedious and time consuming. I never hired a lawyer and contacted the Cali State AG and they assisted with guidance on pursing the lemon law in Cali. I also contact Honda Corporate numerous times during the process. No car manufacturer wants any of their vehicles to be labeled lemon and most will do some sort of action before that happens

All the knick-knacks aren't installed at the factories. Rather at the ports. Mud flaps, step bars, tonneau covers, roof racks, etc. Basically, if it's the last page of the configurer on Toyota's site, it's added at the port.

Just have it detailed, sell it then get another one or another car for that matter if you hate toyota that much now... All the drama is extra. What most likely happened is the rack got installed incorrectly at the port but Toyota did their part to fix it. If it's still a problem sell it and move on.

Totally understandable, none of us are dealing with what you are or know exactly what you’ve been going through with this

Thank you for your advice but I'd really like my money back as I worked and saved for a long time to avoid having a car payment. I'd like my full cost back to buy a vehicle that doesn't smell.

What happened to OP is totally unacceptable. Just because some of us like Toyota doesn’t mean you have the right to attack or “other” OP.

This reminds me of the day after I bought my 2016 Triumph Thruxton R. With 36 miles on the odo, it just randomly turned off in traffic. Dead as a door nail.

It spent over a week at the dealership where they replaced several electrical harnesses, etc. Nobody had any idea what was wrong so they threw parts at it until it worked again. They put 500 miles on it and I had to argue with Triumph to make them cover the first service.

Suffice to say I’ll never buy another Triumph again.

    Yeah.
This is true, although still covered by warranty. How that warranty work gets compensated for is probably a bit different, though. In the case of true factory-installed equipment, Toyota corporate pays the parts and labor, although typically warranty labor pays a bit less (it did in the past when I did warranty paint work). Not sure how port-installed options get compensated for, but it's likely that the distributor (that installs the port options) foots the bill for that work. This may be a tedious process for the dealership to get compensated, especially when it goes into things like remediating mold -- they likely don't have a standard number of hours or a clean way to compensate for parts outside of the installed options, and the dealer doesn't want to get left holding the bag. That said, how a dealer gets compensated for the work shouldn't be the customer's concern. Easiest thing to do would be for the dealer to replace the headliner, carpet, and any insulation or padding that may have gotten wet -- but getting the distributor to compensate them for that would be tough, and corporate is just going to pass the buck back down the line to the responsible party according to their agreements.

Unfortunately this won't happen unless you follow the lemon law process, and based on the chain of liability and this particular problem, it's going to be a fight. What the vehicle smells like may be considered subjective. Confirmed presence of mold would be more objective, and harder/more expensive to prove. An interesting (and unfortunate) case to watch play out, so keep us posted on the outcome.
