    She hit a bright red truck with its brake lights illuminated that could have been slowing for anything. I don't know what to tell you. You seem to think it would only be wrong that he got hit if he WASNT turning, but now because he WAS turning then the turn signal would have made a difference somehow. What evasive action should they have taken that they DIDN'T take when a vehicle was stopping in front of them?

    You can talk about the theoretical all you want, but it is you who don't understand. A truck that was slowing was hit, WHY it was slowing doesn't change that. If you want to believe that a small blinky light would somehow make a difference when a big vehicle with multiple bright lights did, then go ahead. But reagardless, the WHY he was slowing doesn't absolve the following driver from hitting him. The irony is you literally say this in your first paragraph, but then argue that not using a small blinky light is somehow more important than NOT RUNNING INTO A CAR THAT IS SLOWING DOWN. That somehow properly piloting a 4,000 lb cruise missile that is one of the highest causes of death in the US isn't more important than the blinky light.

    If this is the hill you want to die on then keep going, but its silly. Yes, use your turn signals, but if he did or did not it does not change the fact that the car behind hit a vehicle slowing down.

    Yeah, that pretty much sums up your reasoning ability.

    I never said it was his fault. It was the VW driver’s fault. What I’m saying is that is a high risk turn with a strong probability of getting rear ended. Make room, signal, watch behind you, brake hard and get over and out of the fucking way would be the best way to avoid getting run over in that situation.

    Wow, the civilian in uniform bringing out the all CAPS! Must be serious! You seem to be adding in other factors that didn't exist. Sure he could have been struck by tractor beam and hit a space time continuum. Lots of variables here, but sticking to what the video shows, he didn't use his turn signal. That in regards to these facts and only these fact, is contributory negligence. Not saying anything about any other scenario. When you go to court, if you start talking about other scenarios, you will get shut down with an "objection" before it can leave your mouth. Contributory negligence doesn't mean that you are at fault or the other party is at fault, it means that you added to incident. Would the person still have hit him? Maybe. We don't know, but we know that you are required by law to signal a turn and there is potential that the accident could have been avoided. It is up to a jury to determine who is at fault or to what degree they are responsible.

    I did activate my turn signal. It was on for at least 2-3 seconds before the video starts. There were two other drivers that witnessed the crash, and stopped to help. I don't know what they said to the trooper, however. The lady that hit me was cited for the collision. Not sure what else I can say, you'll just have to take my word for it, or not. :notsure:

    On the positive side of things (I suppose), I've since learned that the lady did have valid insurance and things are slowly getting sorted out. Truck was taken to the salvage depot for inspection yesterday, so hopefully I'll hear something from the adjuster soon.

    Sometimes things happen so fast, you can’t see or react to them.

    Had a woman almost slammed into the back of me the other week. Was stopped making a left on a 2 lane hwy, 55 mph…people drive 70+ on it. I’ll glance at my rear view when I am slowing, but I was also looking at on coming traffic for a hole. Next thing I know, heard squealing tires and her shooting off the side onto to the shoulder. Not sure I would have time to react even if I did see her. She was probably on her phone taking selfies…I would have been pissed if she hit me causing to me to drop my phone while I was arguing with you knuckleheads here on Tacoma World. :p:D

    We try to try to be attentive, the human brain only sees a mere fraction of what is going on around us. I used to make fun of all the nannying safety stuff, but now I can see why it is needed. We can’t see all of the stuff all of the time. We need some help. The auto braking has saved my bacon a few times when traffic “all of the sudden” has stopped.

    Autonomous vehicles hit stationary emergency and construction vehicles all the time, flashing lights, arrow boards, and full reflective coverings to the rear it doesn't matter they still get struck. People believe autonomous vehicles are also safer than a vehicle driven by an attentive human being.

    You suffered injuries, so the insurance compensation should be much more than just an issue of property damage. Get a good lawyer. Also, please don't take this the wrong way, but you need to be more cognizant of traffic that is approaching you from the rear, especially when slowing down and/or making a turn. If I see someone coming up too fast, I will flash my brake lights and/or abort the turn. When my kids were little, a farm truck rear-ended my van. I saw him coming and aborted my turn, but he still impacted the rear of my van. Had I continued my turn, he would have flipped my van and family into a 10 foot ditch with water.

    We sure have a lot of Monday morning quarter backs.

    To help with situational awareness I play a game when I'm driving; know the make and model of the vehicle that's behind you at all times. Unless you live out in a rural part of the world, it's nearly impossible to constantly have that sort of situational awareness.

    I'm glad the OP isn't more injured and that the ball is rolling on getting things worked out.

    I agree. It's unfortunate that folks want to argue and bicker over something that is posted. The only think that is important is that the OP recovers and gets his truck replaced. :)

    Hope u recover fast. The impact looks huge!? Wonder how fast v6 was going? I thought Tacoma is. Dry strung in this situation, no injuries or jut a little? What happens if unset hit by an 18 wheeler?

    Assuming you have medical insurance, if you haven't already please do yourself a favour. Call them ASAP and advise of the accident.

    I work in the field and while that piece isn't my area, when I did customer facing work I would always get them to the third party liability area to set up the case/file/whatever they call it.

    I was in an accident at 21 and had a lawyer who turned out to be incompetent. By the time I fired him and got a good one, some of the bills hadn't been filed properly and were sent to collections etc. Had I known to do the above I could have saved a lot of headaches.

    Sadly by your music it seems the VW driver did pull the shortest straw for you :(

    In general it seems the laws protect the ones who don't follow it.

    In particular people who don't pay attention while driving and/or have insurance always seem to have accidents with those who are doing the right things. While who's to say what happened later that day, bottom line is OP is injured and has a damaged if not destroyed truck because of this person. I put injury first for a reason.

    Sorry to vent but someone smashed into my wife's car Christmas week when she was stopped at a light for a good 30 seconds. He was too busy texting even after the collision but of course walked off without a scratch. My wife? Yeah, out of work since and still can't drive much or at night (doctor's orders), and we're out of paid time off for her work and the state program as well. The piece of human garbage at fault is living life while we're worrying about keeping the lights on per se.
