I am not trying to side with the dealer or anything I just want to hear the bullshit for cynicism and to recognize and not be blindsided it if I hear it myself personally

Oh for the love of...are you really this obtuse? You're joking right?

By refusing to return your truck; which they have no property rights to, they are committing grand theft auto.

No, they aren't lol. Look of the definition of grand theft auto.

No one stole my truck. The dealer was told by Toyota to hold the truck until it's repaired.

Could I have made a big scene at the dealer and gotten my truck back, probably. But for the 10000th time, I'm fine with them keeping it.

For all we know Toyota will call and tell me that they can't hold my truck no matter what and maybe the dealer was under the wrong impression.

    Update:

Part showed up this morning and truck will be done today. Never heard back from Toyota.

I guess the parts aren't on backorder. Deff an odd situation. The procedure states parts can't be ordered until the truck fails inspection so it looks like dealers aren't going to be stocking the parts.

One thing I did learn is how much less sluggish 3rd gens are with stock wheels and tires lol.

    A bit dramatic?
They didn’t FORCE you to do anything.
    You signed the paperwork.
    You left with the loaner.

Took your truck in for the recall; they confirmed your truck was affected by the recall. You're upset they wanted to keep your truck to fix it. What did you expect? Sure, "back ordered" parts or whatever excuse they give you to delay the repair sucks, but you took it into them with the intent to fix it. They didn't bend you over backwards or force you to bring it in. You chose to. You even signed for a loaner.

Cliffnotes; you consented to the repair and loaner.

If the truck is financed, then the title is held by the bank and it isn't "legally" your vehicle until it's paid off.

Not sure how being financed through Toyota's financiers plays into the dealership holding it legally, just wanted to mention that anyone who thinks they actually own their vehicle while financing it is not correct. You wouldn't legally own it until you make the last payment.

A boss of mine was in a car with OnStar when a rep came on the line unexpectedly and told the driver to pull the vehicle over because there was a problem with the brakes, and that they needed to have the vehicle towed from the location where it was actually at at that moment. The driver kept going, and they all looked at each other, laughing when the person came back on the line again from OnStar, with no uncertainty, said you’re shutting the vehicle off immediately and you are not able to drive the vehicle any farther. They parked and within about a half an hour, a tow truck and a replacement rental car was sitting at their side.

If they’re liable for taking care of a safety issue via recall, they have the right to hold your vehicle if they deem it unsafe.
