    You need to get a lawyer to handle all this because of the limited, and time consuming options you have:

    1) whatever his insurance denies, you file a civil suit against him for ... and where does he then run? To his insurance to cover everything they are currently denying. It's what he paying them for.
    2) for the diminished value claim, you file against his insurance. Unfortunately on these trucks the hit doesn't diminish the value much, you might get an extra few grand. When they deny it, you file suit against your own insurance company under your "Underinsured motorist" coverage. Once your insurance has to pay you, who are they going after to recover to recover the loss .... his insurance. It all comes down to his insurance

    I am all for supporting folks that are getting back on their feet, but not at my expense. He should not lend his car out to drug dealers and criminals, and ultimately, it is his responsibility to compensate you for the total of damages and loss.

    I agree, unfortunately he only has $15k in liability insurance and he’s jobless living in a halfway home.

    There’s no insurance for me to go after (after the $15K, which will only cover some of the physical damage) and suing him would be fruitless as well as he has no assets.

    Above $15k, it all falls on my collision coverage, which then creates some unique issues from what I’ve been told, aka I can’t file for diminished value against my own policy, only via an at-fault third party. I can, however, potentially file a loss of use claim against my own policy.

    I will have to eat my $1,000 deductible when I make the claim against my own policy though.

    I plan to have a chat with Allstate about it more tomorrow to clear some questions up. So far, they’ve been less than helpful though.

    Im not saying you should jump to threatening to contact the CO state board of insurance… but months into the not at fault accident that totaled our first RAv4 prime and all 3 insurance companies were pulling the spiderman meme point at each other we told them to do their damn job and get the ball moving. In the end we did report them because they lied on several occasions and gave us false information to try and get us to file a claim with the other insurance only when they didn’t have enough coverage.

    Ugh! Insurance is such a scam! Sadly you have to buy it whether it pays you or not.
    I believe if a person drops their insurance it should immediately be reported to law enforcement. Then the vehicle is taken and crushed for scrap. That would get 20% off the roads in Colorado. Should reduce…hahaha…maybe just keep it from going up so much every year. Mine, with no accidents goes up 20-30% every year. Crazy!

    I agree with your assessment of insurance and goal of removing uninsured drivers from our roads. I am not, however, a fan of the method you describe. I suspend all but Comp coverage on my fun cars (a '13 Shelby GT500 and '19 Z06) roughly November thru March every year. During those months when we have snow and the roads are covered with gravel and Mag-Chloride, my cars are safely stored in my garage and don't even see sunlight. Obviously, nanny state confiscation and destruction would be totally unwarranted government over-reach. Owning a car without insurance is not a problem. Driving one without it is.

    The basket fits a 35" tire the bars can be adjusted to where ever your t-slot will allow it
