Wrecked girlfriends car. Im not on her insurance... now what?

    I slid in the rain and hit he concreat ditch at our house. messed up front passenger suspention and broke the oil pan. its at my house.

    She has full coverage but im not on her policy. her insurance is telling her it's not covered because im not on her policy. Is there anything we can do? She still owes 13K on it.

    I thought having full coverage would take care of this. I dont have the money to fix it.

    I would print out and read the policy.

    it is my understanding that the insurance follows the car, not the driver.

    "Full coverage" is not a real thing. It's a made up, meaningless term that unfortunately makes consumers think that they have this when they really have that.

    OP, if they are telling her there's no coverage for this loss, they are required to send her a written explanation and cite the applicable policy language as to why this loss, with you driving, is excluded from coverage. There are several reasons why this might be the case, but to be able to answer you with any degree of accuracy, I'd need to know the reason for the denial.

    Also, do you have car insurance with collision coverage on at least 1 of your covered vehicles? If so, you can report the claim to your insurer.

    EDIT: Just saw this: "at our house." If you and she reside at the same address, and have for x amount of time, you may either need to be added to each other's policies, or specifically excluded from each other's policies. It depends on the definitions in the policy of "resident relative," among other things. It is possible that you are considered a resident relative and have lived there for X, and since you were not added to the policy, the loss is not covered.

    This is your answer. Also, file a claim with your own insurance - worst case you get denied and have to do the same thing with them... But if you are covered on other vehicles, they aren't going to want to pay so they will absolutely go after your gf's insurance with a lot more power than you have.

    Most policies include permissive coverage.

    I heard/learned all of this when I was recently hit by a drunk driver in a borrowed car.

    I think it depends on what state your in; in some cases insurance follows the driver and not the car. Dude, if you haven't already, you might want to check with your own insurance guy about using your policy to cover it.

    I'm not an excuded driver on her policy ,I'm just not on her policy. Her insurance told her no because no property damage and no bodily injury just the car.
    My insurance told me no,I'm going to try again.
    Our insurance companies are different and mailing addresses are different from mine to hers.
    I have full coverage as well. I'll look at my policy. I just feel horrible I did this to her little car. It was truly an accident.

    My policy does have comprehensive collision coverage on my tacoma..

    Take out a loan and get her car fixed. You should be thankful you didn't run somebody over. After it's fixed re-evaluate the insurance on both your vehicles.

    Sounds like an expensive learning lesson for you both. Hopefully you find some resolution, but this is the exact reason I don’t allow anyone at all, including family to drive my vehicles. It puts the driver and the owner in a really bad position when there’s no resolution to be found, and I’d rather my friends/family get hurt feelings when I tell them no instead of either of us having to front money for repairs in an accident, or worse.

    Seems like neither of your insurances want to pay for it, and if the policies are clear to support their decisions, I highly recommend Red Wings for a good overtime work boot.

    Years ago my 2011 Tacoma was hit in a parking lot and wrecked the entire front end. I went home all pissed off because I did not want to make a claim on my insurance. My wife was like "just buy the parts and fix it". A couple of weeks pass and my boxes of parts started arriving. Finally, I had all the parts. Fab Fours plate bumper. Winch, lights. New headlights, 1/4 skid, LCA skids. The works. My wife arrives as its pulled into the garage and I was under the truck. I could feel her presence. Finally she says "how the fuck much did all this cost?" I simply replied "let's just get divorced". She didn't talk to me for a couple of days but she did say to fix it! Fix it I did...

    FWIW, my insurance policy covers other drivers who are using my truck (such as family members): "As long as they have my permission to be driving it." The first time I asked about this it seemed pretty vague and I questioned it. The agent confirmed it and a few days later I received a paper copy if the clause in the mail.

    It seems like since you both have insurance and you live at different addresses, this aught to be covered by one of your insurance carriers. I would expect my insurance to cover any car I damaged, but I guess I don’t know if that is the case.

    At the end of the day, if you have a local agent or office you can go into and actually speak to someone you might get more traction. The circumstances are odd to say the least. I suspect that has something to do with the denial of the claim. Not sure how fast you enter or exit your drive but something seems to have gone fairly sideways no matter the explanation. I am not here to judge your circumstance but think of it from the perspective of the insurance company. Keep in mind they are there to make money so if they can deny the claim they will. Go into the office and make them prove to you why you are denied coverage. Or request they provide it in writing. This probably has more to do with that type of damage being inflicted on your property. I cannot imagine any conditions where that would have ended well from the looks of it. Perhaps building an off ramp into your driveway would be helpful. Best of luck getting a resolution to your issue though.

    I had permission to drive it 100%
    So I don't understand why they are tell her no.
    The lady just told her no property or body injuries then. It not covered and also because I'm not on the policy.
    I told her to call and talk to someone else.
    I'll call my insurance again when I get home and see if I can get it fixed on my insurance.

    Look into your policy carefully, more your own than hers.

    If I borrowed your truck and totaled it, as long as I had your consent to drive it my insurance would cover it.
