Wrecked girlfriends car. Im not on her insurance... now what?

    As for the topic at hand, there are some inappropriate responses in here. Let’s actually stay on topic on this rather serious matter.

    For OP, you do not live with the girlfriend and are not excluded from her policy. Therefore if she has collision/comprehensive, this “should” be covered. I use quotes, because who knows what ridiculous fine print is in her policy.

    Pursue with her insurance company. If they still decline, request the terminology that allows them to decline. Don’t say anything stupid on the internet, and consult a real lawyer if insurance still declines.

    Insurance companies try and deny coverage on anything… it’s how they profit. Keep at it… call the corporate number not the local office. Keep going up the food chain until they can prove she agreed to something that waived coverage for anyone else driving other than her.

    I'm going to look at all her paperwork and read all the fine print. Everything I've researched says if I had her permission to use the car, ( and I did) that her insurance will cover it. Insurance follows the car.
    After this crazy crap is over with we will probably put my car and truck and her car together one one policy.
    Neither of us has ever had to file a claim. So this is unfamiliar territory for us.
    A Toyota forum is not the best place to ask but a good way to get several different opinions.

    You are in California, the Insurance should follow the car that is insured. Submit the claim and see what the result is, I'd say you should be ok. (Retired Insurance Agent) Had lunch at the Boll Weival in Ramona on Saturday!

    My best guess is if you truly did nothing wrong here, gf’s insurance company should cover this. Just have to fight for it.

    Then go find a better insurance company lol

    15/30/5 is way under insured. Get into a real wreck and you will be liable for most of the damage yourself. Just something to look at once the current issue is resolved.

    It looks like she is extremely under-covered, atleast if it doesn’t pan out in y’all’s favor use it as a learning experience and get some better coverage.

    They definitely do not try and deny coverage on "anything", and that's not how they profit. Denying coverage has to be clear cut and unambiguous or the state will crack down, hard. Going up the food chain isn't necessary at this point because he's not even sure what they told her. He needs to know what was actually said and what coverage determination was made before he does anything. Also, you can't waive coverage. You can exclude people from coverage. You can do things that are specifically listed as excluded from coverage. But you can't waive it. You either have it, or you don't.

    Her insurance card wouldn't have any info relevant to this situation. As others have said, she is woefully underinsured from a liability standpoint unless he makes minimum wage and doesn't own any property or many other assets. If she has a decent job and owns a house, bump that up a LOT.

    Also, you're doing this backwards. Instead of trying to read through the entire policy before calling, which can be confusing at times even for someone with my background, you and she should call first, get a clear explanation of what's going on, and then look at the policy to confirm what they are telling you is correct. At this point, you have no idea what they actually told your GF, meaning you don't know where to begin looking in the policy.

    Man I havent been to boll weival in YEARS, I was a little kid asking mom and dad for money for the video games. My girl and i usally go to Cheers just down the street from there, it's more of a bar setting but the burgers are good. She cant drink and i dont drink much any more we go for the burgers and you can bring the stupid dog too!

    I really hope you have no intention to lawyer up. Listening to advice like that is a sure way to lose even more money. This entire deal could be solved with one phone call. I understand you're kinda lost and want to hear everyone's opinion about how insurance works, but nobody's opinion matters. Nobody's policy or their understanding of "typical" policies in your state matter. The only thing that matters is what your GF's policy is. Call them.. submit the claim. Ask them why its denied. They'll be over the moon and more than happy to tell you why you can pound sand and they're not paying; they'll even give you every piece of documentation to plead their case, so save your energy trying to find your own loopholes; they're better at this than you. Just call them and get it over with. If anyone knows what the policy is best, its them. They wrote it..

Or, he finds out that the insurance company has incorrect information and there actually is coverage, or he finds out it's a primary/excess question like I posed before, or any other number of things. The only thing we know at this point is third hand info translated through an upset/crying girlfriend.

    They want your money and offer shitty coverage for low prices.
    Gotta look at your policies to see what is actually covered and what the deductibles are.
    Agents get a cut for signing you on and don’t care.

    Like I said, if the insurance company is denying the claim, they'll be more than happy to provide documentation to explain exactly why they're denying it. I'm with you though, a phone call is very likely going to lead to a primary/excess scenario. Very doubtful they're outright denying the claim, but if they are, they have great reason to. But the only way to know if they're going to cover it is to contact them and use your big boy voice to have a respectful conversation. Threats of lawyers, trying to find loopholes, etc is just stupid, because of the limited info (from crying gf).
