Exactly, while this fool is probably just going to do it again the next day. Those things used to at least be arrestable in MA. Too bad wage garnishment isn't used more often.

Not arguing, but most paces this is illegal, but the laws won’t be enforced and you can’t squeeze blood out of a turnip. My GF worked at a place that had a guy that came in at odd hours for cash, to clean, he’s one of em. He plowed in to a parked car with his truck, no license, no insurance, 6 months behind on payments. He told the car owner “sorry I don’t have any money either”. And goes back to work the next day for cash under the table.

It’s illegal here to drive on expired plates and temp tags, but we often see many that are years out of date. Laws are useless without enforcement.

 

All this especially last sentence, which is when this should be jail time. Have to do something.

 

People like that will still drive with or without a license.
They need serious prison time.

33% of the folks on the road in my state are driving uninsured. Suing them would only add more expenses with no return.
No proof of insurance is required here to tag and register a vehicle, and that's an incredibly obvious contributing flaw.

 

More often that not, you're correct. Especially the texting jackasses. Ask me how I know, since my wife was rearended by some prick on his phone who seemed only to care about having to wait for the police to show up and didn't even notify the insurance or his friend who he borrowed the vehicle from; meantime, she was not able to drive or work for almost a whole year.

 

If you are looking for a serious answer, you won’t get one until a auto collision professional inspects the truck, estimates the damage repair, reports that to the insurance company, they do their investigation, and get back to you.

I think the term “totaled” is a laymen’s term that is misleading. I think people have this misconception that the insurance company is going to buy them a brand new automobile. Not every insurance policy is the same and not every state has the same laws. YMMV.

Generally speaking, your insurance company is obligated to pay the minimum of the cost of the repair and the fair market value of the automobile. It’s your choice to take a check or have them pay the repair shop directly.
