Should I be worried about this clearance?

Elka advertises "induction-hardened shaft" i.e. no chrome plating to chip. It may be better to run without the boot, as long you keep fluids like Cosmoline or Fluid Film away from the exposed shaft.

I'm more concerned about contact with the body than the boot. Not sure if anything twists while cycling

^Looks like there's about 1/2" clearance between the U-bolt plate and the shock body (for visual perspective, the U-bolt is either 9/16" or 5/8" dia.), so you're probably fine.
