    If HR fails to do a deep-dive investigation upon news that a complainant has retained legal counsel, then they are blatantly incompetent.

    Especially if the complainant has even the slightest appearance of grounds for discrimination.


    I retained legal due to my previous employer, and HR immediately looped in company legal even though I never disclosed it. I didn't have to - all of a sudden my emails to them changed in both tone and vocabulary, and they clued in immediately that an outside gun was editing my correspondence. They had zero choice but to side with me in two out of two incidents.
    But, as they say, its a burned bridge and a target on your back, and sooner or later, they WILL fabricate something that is bulletproof enough to stick. And that's why I walked out the same week the investigation ruled in my favor.

    @Its_Taconie I'm not surprised that HR tried to sweep this one under, but it is a very stupid move on their part, because that could be grounds for HR person's termination. Talk to your attorney. The advice I once got was "If HR is incompetent, escalate it to corporate legal next, and let them know you aren't blowing empty smoke."

    Funny, I had this conversation with my wife a couple nights ago. She thought "Human Resources" meant they were there to provide resources for the employees and help them. I had to convince her that no, the humans ARE the resource.

    If no legal lines are crossed, being treated poorly by coworkers gets thrown back at the manager to deal with and doesn't become an HR issue unless the manager attempts to address it and documents those attempts. This usually requires multiple meetings with the problem employee, the manager, and HR in the room. This could lead to a PIP (personal improvement plan) with clear expectations and consequences. At most large companies, putting an employee on an official PIP requires a lot of evidence so the company can defend themselves if they end up firing the person. I've seen this take over a year to address a problem employee. Many managers just won't deal with it.

    Laws in your state may vary as to what can be done.

    Sounds like you work at a dealership. Great job, we made record profit, here's a "pizza party" for all your hard work. Not to mention they are now hiring in new people with little experience for the same wage they pay the guys with years of experience.

    It sounds like you worked at the same dealerships I did. Don't forget now that they hired 3 new guys who don't know jack shit they'll get the easy work and the overall amount of work coming in the door hasn't really changed, you just need to cut 3 more slices out of that pie so all the techs get less hours to bill. :thumbsup:

    That's every dealership I've worked for. 4 different dealers and 3 different brands. It's all the same. Only way I've ever gotten a raise, other than getting certs, was when I threaten to leave. And usually it had been a few years since the last increase.

    I always loved the, we are booked out 3 weeks, we need more techs. They hire 2-3 more techs and now there isn't enough work for everyone. Everyone looking at each other by 2 pm. wondering IF anything is going to come in.

    Don't know your spending habits but many young people today look for instant gratification by buying whatever they want. If that is you then change your spending habits. Only buy what you NEED and can PAY for when the bill comes. Carry NO balance on your credit card. The goal is to get out of DEBT and save money.

    When out of debt and have a savings it should be easier to find a different job. One that may start at a little lower pay but has a future. Or take that night course to learn something new.

    Stop the whining and do it !

    Not sure if you were referring to me cause I'm not young lol. I always saved up till I could afford to buy with cash, and have no debt. I agree credit cards get a lot of people in trouble. Finding another job isn't the problem, everyone is trying to hire. It's finding something better, that's hard. From the responses in this thread it seems like there's a lot of people not happy with their work, it's either coworkers, management, the job, or some combo.

    appreciate. The shitty part is the person that convinced me to take the position is the one that still wants to run her mouth, and one other minion. She was the manager. It’s like I was set up to fail from the start by her.

    the same woman that convinced me also molded HR to be on her side. The day they came back drunk that same woman was knocking on an attorneys office thinking it was HRs and once she was in her office gossiping, can HR really sit there and not tell she was drunk. So I was doomed from the start of the meeting cause they all consulted each other. “Deny deny deny” they shifted their attention to my performance up to now on the position. Doomed from the start.

    I should’ve mentioned that I work at a law firm that specializes in labor and employment. Turned 100 years this year. Ha.
    The attorney I spoke to is who we’d have to inform if HR doesn’t do their job. For the most part she did her job but again, they just chopped it up at me “not working well with others and inexperience in the position”

    I don’t bring work drama home, and I don’t bring personal problems to work. I’ve respected people at all my jobs and whether they’ve given me shit, I still stay true to who I am. I say good morning, good night, thank you and am polite. Them in the other hand, would say all those by name and exclude me. Doesn’t matter to me. Just shows how petty they are.

    I wasn’t allowed to show proof cause I have recordings of them talking about me.

    but I did call another firm about it and all they said, unless I get laid off…is only when they would get involved and ask to take as many notes as possible and not to record cause if it ever gets to that point, it’s not admissible.

    we have a new crew that’s training with them to replace/take over when they’re gone and even now, you can see that manager trying to mold them to her side and I’m sure she’s already informed them about me. Our new manager has stood up for me though and has told me, they’re trying to get under my skin so they can fabricate or take action and terminate me. It’s pretty hard to get under my skin. My wife can’t even do that. Ha.

    Just today they were all talking and I can hear little jabs at me but unless they specifically say my name I can’t assume it’s about me is what HR told me.

    I think after they’re gone, the new people will see who were the bad influences. I hope so at least.

    Exactly the same in the 5 dealers and 2 brands I went through over about 14 years in the business. Actually the one chain store I worked at was kinda the same BS too.

    Man that sucks. You know what really pisses off the office saboteurs? When you show up to work every day, cheerful as a lark, with giant smiley "good morning" to the new folk, and not a single negative word ever escapes your mouth while on the clock. From experience, that drives the negative nancy gossip club insane. And the madder they become, the more motivating it is to be Mr. Sunshine and Rainbows.

    May I recommend starting a journal, with dates and incidents, and perhaps using those prior recordings to jog your memory when starting said journal?;)
    Not that you'll ever need it. But it's nice to have when you do.


    Either way, good luck, I hope your situation gets better in 2025. As an old wise mentor once told me, "Whenever your day looks bad, at least remember you always have more ass than what they can chew."

    Yep it's industry wide. I worked at a chain store for 18 months. it was actually worse than the dealer.

    And management wonders why the good experienced techs are leaving the industry. You can't replace a guy with 10-15 yrs experience. And when they can find someone, they have to pony up the money it would have taken to keep the experienced guy. Everyone sees it and gets pissed. And it becomes a snowball effect or guys leaving. Just watched it happen at the dealer I'm at.
