The person doing the surrender representing Toyota and Sedgwick is the same dealership TWAT that lied to them about my loaner and refused to assist me and answer any questions throughout this whole process. And she writes one of the checks!

On how everything she told you was bs, she handled this situation, poorly, lied, avoided me at all costs, wasnt prosffesional, blah blah blah...

It will be lesson to everyone that might be in my position. Lemon laws are state to state and they are absolutely cut and dry and a lawyer is really not necessary if you are not looking for punitive damages. Have a ton of patience (I have about 1/8 ton) and as we all know the dealerships once again prove how unscrupulous and soulless they really are.

 

after the check clears .... I'm Italian which means I'm vindictive

 

4 months dealing with this, I imagine the 1/8th ton is pretty much spent...good luck today.

Of course there was no lawyer involved. Any lawyer, even the incompetent ones, would have told you to STFU online and delete this thread. For the popcorn, I'm happy that wasn't the route you took. But, for the lessons learned, it's to hire a lemon law attorney and this whole process would have taken months less time, and way less headache for you. The stuff you stumbled over/got shafted by, they've done thousands of times and can do it in their sleep.

PS - the manufacturer would pay legal fees, so it would be no cost to you to hire one...

Taking less time, sssssooooooooo in-correct.....
Attorneys are doing stacks & stacks of these along with their other lawyering responsibilities....
My buddy got an attorney involved same time I filed directly, took the attorney at least 2 months to just file....
vs you having a 15 minutes conversation with toyota directly & they do all the work, its usually straight forward...
Some errors were made here on Toyotas end, not the end of the world..

 

Yep. Going through the process the Lemon law attorney i contacted said that the quickest way is through oem and if they say no to contact them so that they can take the case

 

The peanut gallery on this forum seems to think otherwise & quick to, "you should lawyer up, that's where you went wrong"
Posting this for the public to see, isn't going to give you a negative outcome, the law, is the law....

I had the same attorney my buddy used look everything over & also commented, were ready to jump-in of you need us to but you did everything right.

If you read the lemon law you'll see that the manufacturer is bound by state law to do XYZ. Who gives a fuck if they or the dealership reads this thread... honestly. They can't deny me anything they are required by law to give me. I spoke with my personal attorney about all this prior to any actions and he agreed that the attorneys that you see advertising lemon law representation are not going to give this nearly the attention and timely responses that I would be able to do myself. They file and wait and get paid. I seriously doubt Toyota corp would risk not following the law because I talked shit about them. And in my opinion this thread could help the next guy instead of going in blind. And by me speaking out here I also got some good info that helped me navigate this whole process.

That's the battle I am having now. I'm real skeptical about another 2024. You can pick up another 2024 for probably 4k less than I paid for the lemon right now or wait for a 2025. I've been looking at 2023's with low mileage also. They average about $35k-$40k which is a few thousand under new. Going to dig deeper into when the 2025 Xtracab is coming out.

That would be pretty fucked up.. a multi billion dollar corporation bouncing a $33k check!
