    So if it fails during the bumper-to-bumper warranty period, you're not going to demand that Toyota replace it?

    Yeah, thing is they have expressed zero interest in seeing the Master Tech's notes or in seeing the part itself. It's just, "No." I don't think that would change if I had video of the tech uncovering the part.

    I don't think anyone in engineering or manufacturing is aware of it. The info I have seems to be getting shut down at Toyota's first line of defense - The People Who Say No.

    Toyota told thousands, if not millions, of Prius owners to pound the sand when asked about a head gasket failure outside of the warranty. Not sure how you are planning to convince Toyota to reimburse the one in million case.
    Read 1 sentence of the warranty statement. Manufacture and Workmanship defects are Only covered during warranties period.
    I'd love to get reimbursed by Toyota for my time and parts.

    I see a distinction between a part that wore out or failed after the warranty period and negligence that resulted in failure.

    The surgeon that leaves a sponge in the patient that eventually kills him, the lube tech that forgot to re-install the oil drain plug. I don't know that the negligent party is allowed to put their own expiration date on liability.

    And that's just speaking from a legal angle, not even getting into what is the ethical thing to do .

    Again, it falls under workmanship defect.
    My head gasket falls under a defect in materials.

    Well you and I can go back and forth on this all day. For me it boils down to Party A suffers damages as a direct result of Party B's negligence/incompetence. Party A is entitled to compensation. It's the fundamental premise of the US legal system.

    I thought a lot about this and I personally think that this extra part was / is indeed a manufacturing defect. Just because it was an extra part that got missed during the engine build does not make it something other than a manufacturing defect. Thus, standard vehicle / drive train warranties apply here.

    The statute of limitations may run from the date of discovery if it’s a latent defect, written factory warranty not withstanding. You need to consult an attorney in your jurisdiction that handles these kinds of cases.

    Of course, the value of your case may not be enough to interest an attorney.

    The key word here is "Workmanship" Leaving a stray part in a new engine is definitely poor workmanship, at least where I come from it is.

    Just wanted to say that I work for an OEM in a different industry, in the Quality department, and Quality departments just don’t really care about 1 off problems. They also really don’t care when it’s years later and out of warranty. There isn’t much of a business case there.

    Failure to parts is one thing. Then the warranty end is the end . 100 percent . But in my opinion 200 k miles and 10 years or 5:k miles and 6 months it’s the same thing . The manufacturer was at fault here and they should be on the hook . The fact that it went so long with out failure was pure luck.
