    just a couple of things tbh
    i was informed to not mention the lawyer by the lawyer. she said sometimes the dealer will take it as a threat in a sense. so she told me to go in calm and try and get the title fixed and comps for it while its being fixed. or get the bike bought back in full and get the money back from your trade in, insurance for the time frame and the payments.

    for sure will! gonna have to rant somewhere haha!

    ya honestly! i get nervous on shit like this because i hate dealing with issues with other people like dealers...gonna talk with the gf before we go up and make sure its all good and sounds right haha.

    What a shit sandwich. Keep in the back of your mind that they (like car dealers) have a state license that they have to protect. The state doesn't look kindly on dealers not properly following titling procedures. IIRC, there was a big (Ducati?) dealer in MI that lost it's license in the last year for shady handling of licenses.

    Don't be afraid to write what you want to say down. Having notes will make sure you hit all the points you want to and don't forget anything. Put it in a notebook, take it in with you, and also use it to WRITE down everything they agree to, everything they promise, including dates, and their general attitude. Even if you need to ask them to hang on while you write stuff, or repeat things, that is fine. Then, they can't say that they didn't say something, plus, you have an accurate account of what happened if you need to tell the lawyer. Also, ask for them to provide you any agreement reached in writing. Make sure it is on dealer letterhead. Compare it to what you wrote in the notebook in front of them before you leave and have any discrepancies fixed or explained.

    And do all of this politely and calmly. Be polite, and gracious. Tell them you are writing it all down so you don't need to rely on memory, if they ask.

    tbh i dont think i even own a notebook anymore haha.

    but ya its not a bad idea to write it all down and have all the points setup to ask them on.

    plus writing it down for what they say as well... ive already had issues with them in the past .

    I would agree with your lawyer in not mentioning the lawyer when you talk to the dealer. In many cases, once a lawyer is brought up communication comes to a halt and they defer you to theirs, forcing your hand.

    They are well aware that you could bring that resource against them already, and if they aren't, well then you've already won lol.

    Ask permission to record the meeting. I've had to do that in the past and that shows quickly that you're very serious about what's going on. Keep in mind that in many states it's illegal to record without the consent of the other party and can get you in a lot of trouble and lose your case immediately so ask first.

    Lol true true bad thing is I'm a bit slow to hear and type things.
    Never thought of that TBH. Will have to do that.


    I did look it up and in the state of missouri it's legal to record its called the one party consent. So if I'm in the convo I can record it without the consent of others it seems.

    I'm not sure I'd want to record without their permission. They may consider that they have "reasonable expectation of privacy".

    • No expectation of privacy: Missouri's law extends to conversations where a person has a "reasonable expectation that such communication is not subject to interception." You may be able to record in-person conversations occurring in a public place where there is no reasonable expectation of privacy without consent. A car dealership is generally considered a private business, so while you are on their property, they may have a reasonable expectation of privacy in certain areas where private conversations might occur, like in a closed office.

    Meh we used the recording to be able to wright things down. Since in missouri it does state that even at a dealer you can record without telling them so not to worried about it tbh.

    Update for the title bs.


    ATM the dealer is working with me to fix the title. ATM the title is being over night shipped to copart to have the section they messed up fixed. We are in talks with the DMV as well to see if everything meets the criteria that missouri calls for. The title will be back within a couple of days but no later then Friday is what I was told. They will be covering any fees the bike has gotten since I haven't been able to register the bike. I was also given a temp tag so I can now ride the bike and a signed document showing that dells did own the vehicle and it was acquired properly through a auction site legally and that I'm now the legal owner of the vehicle in case I get pulled over.

    So if this all goes well the bike will be registered at the end of the week if not I told them I will be back and you will be buying the bike back off me.


    ATM I didn't ask for comps since they did give me a temp tag to ride the bike and are trying to expedite the situation and have it solved within a couple of days. So now we wait and see I guess.
