    Considering taking my old landlord to small claims court lol
    I raised concern over the deposit refund amount after they stole more than half of it, claiming cleaning fees, carpet cleaning fees, landscaping costs and other bs, and refund discrepancy as the deposit - their invoices was like 1000 but they refunded like 900.
    Now they're claiming I owe them another $90 and they overpaid the refund :frusty: through a load of horseshit.

    My claim would be for unjust enrichment of $450 (I think the restitution would be doubled under AZ State law for wrongful withholding), as I paid $600 in cleaning fees on move in ($300 cleaning fee, $300 pet cleaning fee) and they are not applying that money to the $450 of cleaning services. Claiming they are non-refundable (they are non-refundable in the lease, but I dont want them refunded I want them applied to the services they are supposed to be used for), which I guess in their minds means that they just pocket it and take the cost of cleaning out of my deposit.

    My lease states the losing party is responsible for all legal costs, so not sure its really worth it in the end in case I lost.

    Damn, they make it sound like you were a slob living there

    At some point, the landlord must be responsible (and expect) to cover many things themselves afterall...you lived there for a bit so it won't exactly be move-in ready for the next tenant

    That goes for paint, carpets, etc (after I think 5-10 years or so) that should be fixed and/or replaced due to normal wear and tear

    On the otherhand, I'd just write it off as it ain't much and you could be on the hook for even more like you said

    Lived there for more than 2 years, and was early on every single rent payment. Only ever had them fix 2 issues the whole time..
    House was left exactly how I got it too, it was nearly spotless..

    They truly are just trying to use my deposit to pay for everything. Especially bullshit since no matter the condition of the yard or carpets I left, they had to have the carpets cleaned and the yards maintained while theres no tenant. So they're just forcing me to pay for it..
    And where the fuck did my $600 in cleaning fees go if not to pay for cleaning

    Paying them $90 doesn't change anything for me, getting all that money wouldn't change anything for me, but damn its just the principal of it that has me ticked off...

    Phew! I was afraid you got a DUI or something visiting future Mrs Time623 again this weekend…

    I will forward this to him to see if he has an opinion or any advice. He’s a criminal defense guy so may or may not know the law here.

    Small claims is kinda the Wild West so you don’t necessarily need an expert legal opinion. You mostly have to decide if the hassle is worth your time. That said just the threat of it may bring the other party to the table to hash something out in order to avoid it.

    IMO you should be more focused on your current landlord and how much they owe you for your pest control services!!

    Bit worried to threaten them with it, I imagine they'll just claim more bs that I owe them like the last time..

    Funny thing about that pest control services, week 1 we contacted the property management company to send a guy out for it. He came out and sprayed inside and out. Couple weeks later, management company says landlord declined the charge and we would be responsible for paying it.

    Landlord then (related/unrelated unknown) canceled their contract with the management company, and covered the cost..

    That also had me ticked off before the landlord covered it, would've been like $350, if I had known we might be responsible I wouldn't have had them out in the first place. Would've bought everything to spray it myself, probably still will do that though.
