I guess not. Only Because jailbreaking isn't illegal. Besides. The apps that you get. Are shared files. So technically its not stealing

So if someone took a bunch of your photos and posted them on a share site without your permission when you were trying to actually sell your work, you wouldn't consider that theft?

I guess everyone has their different point of views.

EDIT: and that is a little bit different as well. If they were claiming they took the photos, then yes that would be theft. If they are sharing my work. Then no. Thats not theft. Im not claiming i made the app and its mine lol. I just got it from someone else that bought it. Basically.

If you really want to get technical. Say your friend bought the $70 tomtom app and it's on his iTunes. And you want that same app and you dont want to pay for it. You know you can get it from him, just by plugging in your phone to his computer and dragging it on to your phone. Is that considered stealing? No, thats simply sharing a file someone bought on iTunes. Thats exactly what i am doing. Except I'm not plugging in my phone to a computer, I'm doing it wirelessly over the internet.

AND to add one more thing, it's really not even the same app. (yes everything you do in the app is the same and the layout is the same) But, it's a cracked/hacked version. So i am not stealing from TomTom, because I'm not using their app. I'm using an app someone re-wrote the code for.

EDIT: Not to argue with you Robert, just saying :p

So when i say that i mean, when you download the app from "Installous" (the jailbroken version of the app store, where you get apps for free), and there is an update out for the app. You cant update the app the the Apple App Store, because i didn't get it from there and the updates don;t work for it because technically it isn't the exact same app tomtom put out...

It's not any different, they're both intellectual property. What if no one ever paid for it? What if company x just likes the picture for use on their site to sell their products? Your work, photography, is a service based on your unique vision. If all your work gets taken (not paid for ever because someone can just take it), you don't make money.

In the same way, if you're taking software that you haven't paid for, which the creator has not authorized to give away, that's theft (software piracy is definitely illegal). If you choose to give your property away, that's your right. However, unless TomTom is giving away their navigator software for free in the app store, it's copyright infringement.

I guess it's surprising to me that someone who is looking to make a living off their intellectual property would disregard someone else's efforts or see it as something different.

just because it's cracked, that doesn't change anything. It's still someone else's app. If anything, this contradicts what you stated above. Someone else has taken TomTom's work and now you see it as theirs rather than TomTom's. Seems inconsistent.

But everyone in the Apple App Store makes their products to be shared. Its different than a software, where you have a one license for one computer. You download an app on the Apple App Store, and you can put that exact same app on other devices, because its someones property, and they can choose what they want to do with it after they have bought it. Apple approves of this, and Apple allows you to do this. Thats why you are able to do this via iTunes.

It would be the same thing with photography. If someone bought a photograph of mine, they can do whatever they want with it. Because i sold them the photograph, they have the copyright to that photo. I have given them the permission. Because i have gotten paid. So i could care less with what they do with it. BUT if they stole a photo directly from me, with out paying, then made copies for other people to have, then yes thats stealing.

You are right, it IS the same thing. But thats all im doing, getting a shared file from someone that has already purchased said app. (Or just rewrote the code to it, but someone has to purchase the app before they can do it anyways.) People make apps with the same intent of photographers (now that i think of it) once someone purchases the app, the have the right to share said app, because they have bought the app. Thats all im doing, download a shared file. From a person that has already purchased the app, i am not download the app from tomtom for free using a software. Yes that would be stealing.

EDIT: Or, if it was illegal, they would have done something about it by now. But the beauty of it is, is that wether or not you or someone else thinks it's illegal, it's still not! :)

You're wrong. You don't own the app. You own the right to use the app.

Maybe you should email Tomtom and see what their take on the issue is.

Legality of jailbreaking (from un-official sources, but everyone says the same thing, but then again i could be wrong. Because they aren't official sources.)

    http://osxdaily.com/2010/07/26/is-jailbreaking-your-iphone-illegal-not-anymore/

    http://www.wired.com/threatlevel/2010/07/feds-ok-iphone-jailbreaking/

    http://en.wikipedia.org/wiki/IOS_jailbreaking

After talking about it, illegal or not. I don't feel i am doing anything wrong and no "official" has ever said i am doing anything wrong. As for my opinion, i have always heard it isn't illegal. Will i stop? nope.
