Just because this particular officer had a bad day, doesnt mean he's a bad cop. Of all the cops I know, very few have a picture pefect carreer. just like many of us, cops have bad days. Some worse than others.

That kind of action is ridiculous though, especially when they are in the wrong!

you carry a gun in the open as a deterrent. If some people were going to mug you but they noticed you were carrying they most likley would not even try. If you had the weapon concealed and the same people tried to mug you you might end up shooting one of them in defense. Which is better, having the gun in plain sight and not using it, or concealing it and possibly end up using it because the person attacking you did not know you had it?

and to everyone saying he was looking for a payday, he said in the interview that he has had negative encounters with the police before because he was legaly exercising his 2nd amendment rights. Having the gun is his self defense in a rough city, and the recorder is his security in case an incident like this happens so it is not his word against the police, in which case he would lose.

and 650H1, dont worry. There are people that remember and are thankful for fair and relaxed cops, i know i am. :D

Let me point a loaded gun at you and let you guess what my intent is. Your intent is proven at that moment when you point a weapon at someone, because there is only one thing they know at that point. Oh shit.....

I've been in situations where I had to point my gun at someone and given the instance, that level of force was needed.

If you're in a gas station with a gun worn fully visible, and a guy walks into the gas station with a gun in hand ready to rob the place, most likely you'll get shot at because you are a threat to him. I feel that an openly carried gun in civilian clothes can act as a threat towards my safety and those around me.

Yes I would rather carry concealed and end up removing the threat then becoming a target because I have a visible gun that is a threat to the bad guy.

If we were talkin bout being mugged at thr convenient store- yes I'd agree a pointed gun equals intent. But we're talking about a cop pointing a gun and shouting commands- big difference.

And ur logic is seriously flawed in this case- the guy was uncooperative- indicative of him NOT fearing imminent death. If he really thought the cop was gunna kill him he would've hit the ground in an instant and complied with any and all orders.

    Nice try though.

the cop was standing there, pointing the gun at him, screaming " i am going to fvcking kill you" how much more do you need before you start to think that this officer is going to blow my brains out?

In that case, if I was that guy, I woulda shut up, and done what the copper said. No sense risking your life trying to prove you're right.

someone didnt listen to the audio..

he states he uses the recorder because of pas experiences with Philadelphia PD. If you're going to continue to act like every cop is under fire here then perhaps you should go ahead and explain the corruption of cops in mexico.

Harden your bark, there are storms on the horizon.
i for one am glad there are citizens out there who will exercise their rights. like LEOs, they do it so I don't have to wether it be the right to bear arms, freedom of speech, search and seizure, religious practice...i am thankful for all of them, and owe a debt to those before me who's foresight and continued vigil allows me to retain them.

I was a cop in tulsa Ok and carried the badge and six shooter with the tulsa pd for 5 years. I am truly shocked at your failure to understand intent!!! The intent is when you point the weapon...just like when you break into a house the intent is to burglarize. Later you can plead down to breaking and entering. I made felony stops before you were even out of grade school if that makes a difference and yes I made felony stops and I pulled my weapon a total of 7 times killing one man and shooting another. Coincientally I worked patrol for two years and traffic for 3 during the hours of 1600-2400. So I am very much aware of the risk posed by police officers and the intent or lack of it that can get you indicted. Are you?

And no I "never" let me repeat that I "never" pointed my gun at someone as a matter of procedure. In Okla at my time we still had the shoot a fleeing felon rule (which I understand has now been overturned). If you want to fall back on procedure go ahead but is procedure law or admin? If it's admin then you can hang yourself out to dry in the civil/criminal courts---you should know this. If not then go back to school and urge your dept to bring you in for inservice training....

Just out of curiosity if you shoot an innocent person have you committed a crime? Do you really feel comfortable testifying in front of a grand jury and saying "yeah I pulled my gun and pointed it at the suspect as a matter of procedure---I'm really sorry I accidentally shot a guy that wasn't guilty of a crime that I am aware of! That's called manslaughter at the very least and murder in the second at the very most. Haven't you ever heard of those crimes. By the way I bet your the guy who will arrest someone if your supervisor says arrest them...don't ever do that. That is a civil rights violation and if you testify you did what you were told you will be asked "did you or the supervisor put the def. in jail?" You can figure out where it's going from there.

Even in Terry vs. Ohio the cop did not pull his gun out and accost the excon....Be very careful Officer you are walking a very tight line and my heart goes out to you. It's a tough job but no one made you stand up and volunteer. Good luck and stay safe....and stay legal!!! Wearing a badge does not give you the right to abrogate the constitution...

Mr Brown I appreciate and found your comments very interesting. But I am not a war path for anyone except the cops I want to keep out of jail. Look at NY City where Detectives shot a man and his car more than 30x. What about the cops in LA that were fired after they shot an individual and how they are now in Prison. I don't believe any LEO should ever have to go to prison and it is my intent if they are any LEO's reading this for them to stop and think about what your doing. It may mean the difference between prison time and retirement. Look at the two border officers that shot a drug smuggler and went to prison until Bush pardon'd them. I just don't want any COP to go to the jail house for bad judgement or something they could have prevented.

What I think will be interesting is to see how women cops are treated for shooting a person who was overpowering them and had committed only a misdemeanor all of this will be extremely interesting to read in the years ahead...
