    Pretty sure he said he just considers it as part of his investigation and determination of probable cause. While his attitude is cavilier-His statement is correct. He can not use the fact that you denied him permission to search as grounds to search- but he can consider the totalatity of the circumstances in his decision regarding further non-intrusive investigation.
    You don't have to say anything over and over- Once you've denied consent-You've denied consent- That has NO bearing on the police working to develop PC to get a warrant/search without consent.

    I think that's the one thing that folks are missing here- Even if you hold a sign up and have it tattoo'd on your forehead- Those things won't stop bad cops from doing what they have done to the OP in the past- and good cops won't end up in that position after you say "I do not consent to any searches"

    No. There is nothing wrong with wanting to protect yourself against unscrupulous law enforcement officers. For example, as I write this there are at least at least twelve (12) San Diego police officers that are under internal or criminal investigation since October 2010. The allegations include drunken driving, domestic violence, assault, excessive force, sexual assault and on-duty rape. Five have been charged in court.

    Wrong again. You don't understand the law, so casting judgement on something you don't fully understand only makes you look dumb.

    I like you. If you violate my rights, my high powered attorney will make your department pay and while doing so, he'll make you look like a fool. When Sam Wolanyk's rights were violated (Four (4) hour illegal detainment), his attorney made San Diego Police department pay. They settled for $35,000 plus legal fees. My attorney tells me that he can do much better too.

    You completely missed the point about the sticker. However, it's been clearly stated in this thread.

    "if i had that sticker/ decal in my car, the first time i could have proved to the judge that not only did i NOT consent to a search, i have it plastered to the interior of my car" - the sticker proves nothing as he could easily override it verbally.

    Second, I need to hear both sides of a story before passing judgement.

    Third, yes, we all know there's bad cops, stories of them are unrelated to this specific incident to which we only know one side of the story.

    dont know about cali but here in GA signs hold no legal weight...like a mall putting up no skateboarding signs they have to physically ask you to leave if you dont then you can be charged with tresspass

    I applaud your training but still fail to see why all of this plays into your views. I respect cops for risking their lives to make the world a safer place, but I don't like your attitude concerning citizen's rights. Seems to me you consider yourself above the law like a lot of officers do.

    dead on what i was thinking. EVERYONE has the right to say no to a search. unless there is reasonable cause of course. why do we need to say yes for you to search our personal property?

    I'll say it again- Go back and read what he wrote- He was being cocky about it- but he said- He's going to pay extra attention to developing PC if you deny him consent to search.
    If you are doing nothing wrong- You have no concerns cause he won't have PC. If you are doin something wrong-He may or may not develop PC. If he searches with PC developed by lies- You have a civil suit (and you won't stop him from doing it no matter what-which is why civil recourse exists). If he searches by PC developed to the legal standard- Then something is amiss with the story.

    I think you confused my post with someone else. I didn't call you any names. "Ride alongs" are great and I have done them with federal LEOs. Thanks for the invite, sincerely.

    With respect to your post, your accolades and career achievements are commendable, and I highly respect that. But they are not an excuse for violating the rights of the people.

    That's what the 4th amendment was supposed to do before it was shredded in the federal courts.

    The stickers absolutely carry weight. You can serve notice of your rights verbally and in writing. Just ask any competent attorney.

    Why is everyone saying dep3091 is violating peoples rights? He said he will search for PC, which will give him the right to search. Its our job. Thats what we do in order to get the drugs and illegal guns off the street. OP I am sorry you had the bad experience. I have only heard of agencies doing that to vehicles when drugs are involved. I feel like there is something missing from the story, because that would be way excessive to do to your vehicle over a gun. If the story is correct, then it sounds to me like you have some sort of law suit on your hands.

    Thanks bro...I'm not sure how I got that tag either. The funny thing to me is that people think that I'm cocky just because I told the truth. I am and have always been one of the most mellow and fair cops in my department. Granted, no one on here actually knows me. As for those who "hate" cops...I hated cops too...until I became one and saw the other side.

    Am I the only one that finds some of this hard to believe unless there is some extenuating circumstances? Things would have to have gotten pretty crazy in order to start dismantling headlights, and if I did, I wouldn't have had black glue and try to put it back together. ???

    The only possible explanation I can think of is the vehicle was impounded and a warrant was obtained. If this was the case, judges don't just sign warrants, there would have been reasons.
