Tacoma Wreck - No Insurance

    Argh..

    The Prius driver didn't have insurance when he crashed into me. My deduct is 1,000.00. However, he has offered to pay cash to get the vehicle repaired. The total damages so far:

    Body work: 4,000
    Mechanical: 3,500+

    This should be... interesting. I'm thinking I'll tell him to give me cash for the body work and I'll take care of that myself, then I'll have the dealership order and install after-market parts of my choosing, so my warranty remains valid.

    What can I do to my truck with $7,500?


    UPDATE:
    Hey guys, apparently he's going through a divorce and the insurance got skipped through, it lapsed from June 20th to July 15th. I confirmed this with his insurance; he missed a payment.

    He owns a photography business, a high profile one here in Salt Lake City, which pulls in a lot. Apparently his clients are the LDS Church and Intermountain Health Care.

    The estimates were completed at both a body shop (Shine Collission) through the Insurance (Progressive, mine) and at Karl Malone Toyota. I had both Karl Malone and Shine create an estimate on worse case scenario.

    I have a 1,000.00 deduct because my insurance was running me 340/mo, now it's down to 240/mo and I just forgot to swap back to the 500 deduct. I'm not concerned; I talked to Progressive, they said they should be my Plan B, but to make sure all estimates are agreed on by them before doing any work, otherwise if this goes south with the other driver, they won't cover mechanical, only the body work. This means a lot of hoops to jump through with the estimates.

    I'm meeting the guy for coffee to go over options. If anything doesn't work out, I'll pay my insurance, and they said their legal team will go after him for the money.

    Let's assume he pays; what should I do to the truck?

    Here's the bad news... if he didn't have insurance, he sure as hell can't afford the cash price to cover all of those repairs.

    Here's your best solution: Catch him while he's still generous.. like right now. Tell him you'll settle it all for $2000. Take half of that to pay your deductible and then you file a claim with your insurance and get the work done right at a shop. As long as the accident isn't your fault, it's illegal for your insurance company to raise your rates.

    And.. you have $1000 in your pocket for mods on your newly fixed truck :D

    This- Lots of folks say they'd rather pay out of pocket than use insurance until you tell them it'll be thousands of bucks to get it done and then they change their tune....
    I'd take what you can get and go to your insurance...or plan on taking him to court.

    My wife runs a major national Insurance agency and she pointed a few things:

    Don't EVER under ANY circumstances accept cash for repairs in an automobile accident. That's honestly about as dumb as purchasing a house without having it inspected. You have NO idea what kind of damage has been done. Even when you take it into the body shop or dealership, they give you ESTIMATES for a reason, because even they don't know to a full extent what kind of damage has been done until they start tearing it down. The smartest thing to do would be to file a Police report. That will make it more credible in the unlikely event you'll have to take him to small claims court.

    Also, if you get into a wreck with a person who is uninsured, the insurance company will only pay for it if you have "uninsured motorist" on your policy. I assume your do otherwise you wouldn't be mentioning your deductible. Lastly, why on God's earth is your insurance deductible $1,000??? Your deductible should be $250-$500 MAX. What that tells me is that your deductible is outrageously high because you're trying to get the absolute cheapest monthly payment which is also not the brightest idea. You may be running around with the bare legal minimum to be driving, and in the event you get into an accident your coverage might be exceeded and then you'll really be in a bad situation. That also tells me that who ever wrote your policy doesn't give a flying shit about you as a person. It's almost irresponsible and frowned upon in the insurance business to write a customer a $1,000 deductible plan. My suggestion would be once this is all over don't walk, but RUN from your insurance company.

    No Police report? You better tell him you want all the money now (whatever you agree on or your turning him in). If you turn him in, you may get something at some point, maybe even little by little. But if you go the other route, say take his $2000 mentioned above for example, when you go to file with your insurance company and say you were invloved in an accident with this guy, then thru discovery they find you were paid to settle with this guy (the $2000), but then you filed with your insurance company you may be in trouble it would seem. Let him pay as he goes if does not agree with ins., have him pay the entire bill. If not, do not let him get away with driving without ins. unless he is willing to pay the full bill. :cool:

    i have been in this boat before once they figure out they cant afford the repairs they dont pay. get a lawyer and get there license took away until the debt is settle and be a Dick every time you see them call the cops. dont trust them and good luck

    It doesn't tell you anything. Most financial planners will tell you it makes good financial sense to go with a high deductable if you can afford the deductable. It doesn't make sense if you're strapped for cash. So if I have $1000 sitting in the bank to cover the deductable, why pay more for a lower deductable? Paying extra for the lower deductable is just wasted money. Most people don't get into accidents that often (I've had about 4 in my lifetime). With the difference in policy costs, you'll make back the deductable amount within one year easily.

    The problem with small claims is yeah sure you'll get awarded a amount to "settle" the case..but the person doesn't always pay the amount...it's YOUR responsibility to get your awarded amount. The court doesn't help you on that part..last time I checked.


    $1,000 deductible = saving costs on monthly premium,specifically comp or collision.
    Do you have uninsured motorist? It's very cheap to add to your policy, and you will NOT believe how many motorists are on the road these days without insurance..I've seen people who buy a policy to just get their car registered and on the road, then cancel it within a month.
    3/10 people at my parent's office do that^...do the math of how many people are on the road without insurance.

    In the end it ends up f^cking people over because they can't fork out $1000 at once without making them go broke in other areas.
    If your agent gave you a $1,000 deductible without you asking, I'd start looking for another agent... *cough*Farmers*cough*

    I'd take $2000 and call it even.

    Wrong... not only can they can legally raise your rates if the other guy's at fault, but they can even if his insurance company pays everything. Especially if it's just one of other accidents you are classified as 'accident prone' and a higher risk.

    I know.. it happened to me. I was hit by a hit-and-run and made the stupid mistake of filing a police report with tag number. He never paid, I fixed it out of my pocket (less than the deductible) and my rates went up.

    Also: the reason for 1,000 deductible on collision is simple economics: why pay almost $200 every year to insure against a $500 loss? No... bank the 200 and self-insure the 500. The difference for a $250 deductible is even more egregious. Drive careful and never use the deductible... if you have a loss-payable accident more often than every 5 years insurance is unaffordable anyway.

    I had $1,000 deductible back when I was 18 years old and was paying $290 a month for insurance because I was a "high risk" driver. Now that I'm older with a clean driving record I dropped it back down to $500 because I can afford it. Deductibles are all about what you are comfortable paying out of pocket when you have an accident.

    That is not always the case..it depends how much your deductible was stated in the QUOTE at first and how much you raise it.

    If it was $250 and you raise it to $500, you'll be lucky to save 20% a year.
    $1300 a year
    20% = $260 a year saved..yeah it's money saved but not much.
    If it was quoted $250, and you raised it to $1000..you'll be lucky to save 35-40%...which is still only $450-520..it'd take you 2 years to get your money back saved for a deductible. That 2 years you gotta go hoping you don't file a claim to be ahead.

    Now if you have a $1000 sitting in a savings account, that is intended for insurance deductible reasons only...just a free $1000...then that's a different story.
