I can use some input in my situation. It's complicated

So I traded my 2009 5-lug taco in for a 2010 Tundra Db cab with Work truck package for business I was starting after leaving military. Well the Tundra had a disabling electrical issue that rendered it useless when it happened. The truck was in the shop over 120 days that Toyota is willing to recognize. On top of that I had a 100,000 warranty I purchased with the brand new tundra which while it was in the shop they denied me any car rental or loaner for my business. To add insult to injury the dealership put 2000 miles on my truck and I got toll tag bills of people driving it after midnight on a Saturday. They did some other crappy stuff that I can't talk about on here too. Anyways. I want to avoid litigation and suing them for losing my business and damages for having to take a personal loan out to have another vehicle so I could find a 9-5. Now I'm back on my feet I want to go to school and don't want the tundra or a replacement tundra. Instead I was thinking smaller so I can commute to college from my family Ranch. This ranch will need my to move some things around like getting bags of feed, supplies, equipment whatever.
So I'm thinking they will be willing to give me something cheaper. I am thinking either a single cab 2.7 4x4 5speed which I could supercharge, or an access cab with the 4.0 6speed 4x4. These factors matter. Ability to feed cows in the morning with out breaking suspension. Must be able to haul a bed of feed at 65-75mph down the highway. I will be commuting to school daily thats about 60 miles a day so mileage will factor in as well. Trail ability. I want to be able to crawl and not have a massive breakover angle. I will have trees to crawl over and hills to climb. Lift will be performed for 35" tires. The truck would have ARB lockers (gears?), camper shell, bed rug, lights, roof basket, multiple batteries, front and rear armor with winches front and rear. Can those of you who are with me sound off?

 

Holy shit, what the hell dealership is this? I see you're in Texas. Can u give the name of the dealership so we can avoid? As for your desire for a lifted truck on 35"s and driving 60 miles a day, you are going to eat it in gas even if you re-gear. Especially with all that extra weight. Man, I don;t know what to tell you but I would be all over the Better Business Bureau about that dealership, and frankly, I would sue the ever-lovin' crap out of them.

If they are "willing" to give you another truck, I'd be looking at a V6 for sure given the description of what you intend to do with the truck. This really does seem to be an odd circumstance... a 2010 Tundra that has a disabling electrical condition and then they put 2K in miles on it and you have proof (toll bills, etc). Seems like this would be a slam dunk in court.

Anyone else have any advice for this young man? I wish you the best of luck but I'm stunned.

Well I complained about it on Facebook and their Lawyer didn't like that. So until our litigation is settled I won't say a name. But I live in East Texas and these guys are known crooks. Well I know I'm not going to get over 20 mpg loaded down with all that weight but I would be able to get decent mileage. My Tundra drinks fuel either way.

 

And again I am not a big suing person. Too many people abuse it and I'm a conservative at heart.

also OP, if they offer you another tundra take it and sell it, use the extra cash toward a tacoma+the mods you want to do. Depending on what kind of tundra and what kind of tacoma you want you could have money left over

 

If there is pending litigation, I don't think anything will be done until that is resolved. May I ask if your legal complaint includes award of a new vehicle as a form of restitution and compensation? If that is the case, I guess you'll have to wait it out and see what you are awarded in the judgement. My guess, with all that extra weight and pushing 35's, you'll be lucky to see 15mpg. That's a shit-ton of drag especially if you add in a roof basket and front and rear armor. The bed cap may actually help in some capacity but it's still added weight.

Did your attorney advise you not to post something on Facebook or in another public forum? Did you receive a "cease and desist" from the dealership's attorney?

It had an issue that intermittenrtly AKA when I needed to drive to work for a call the truck would start but all the lights in the dash came on and didn't turn off, the A/c wouldn't work.... Or the blinkers, the radio, the windows, it wouldn't come out of park and would do this several times after restarts. They had engineers from Toyota found a loose ground bolt faulting the can bus system. What are the first things you check when you have an electrical issue!? Anyways. I'm beyond pissed about it I just want this to be over and have a truck I'm happy with for what need it for.

 

Can you at least tell us what the dealership's initial reaction was when you approached them about the misuse of your vehicle by unknown parties (after you discovered the extra mileage & toll bills)?

I wish you the best of luck, but any Tacoma you get will be better than what you have now. I'm assuming you still have possession of your Tundra, right? Does it even run?

The dealership said it wasn't true then said they had footage of the truck staying the whole weekend there they couldn't find when asked for.

 

I do still have the truck and now it runs. I just want a Tacoma. I will take damages in trade for mods or cash. I still love Toyotas after all this but they need to step up.

 

Hmm? Seems to me, if the truck was in their possession and their are toll bills reflecting the truck went through a toll on X date--a date in which they had it in possession, seems concrete. I'm assuming that your toll transponder is fixed in the vehicle, or is it removable? I know my Texas Toll Pass is fixed to my vehicles window and cannot be removed and reused.

Also, when a vehicle is checked in for service, they always record the mileage. When you picked up your vehicle and noticed the increased mileage, did you ask to see what mileage they recorded when it entered service?

Just curious... this is such a bizarre situation. I've been around awhile and I have never heard of such a circumstance. Incidentally, if this business is known for being "crooks," has their been a class-action suit or others similarly filed demonstrating precedent or propensity? That may help your case.

 

So, in the end, the truck runs fine? So I take it your current complaint is:

1) Did not provide a suitable replacement vehicle during maintenance period of 120 days, which contributed to loss of personal business and related income.

2) Misuse of vehicle while in dealership's possession leading to accelerated depreciation in value.

3) Incurred unnecessary personal expenses due to the dealership's inability to diagnose and correct the problem in a timely manner.

Am I on the right track here?

 

It was a liscence plate billed one so it's obvious and had a picture. This is getting off topic though I just wanted to know about which truck would be suited for me. I'm firm in not taking someone to the cleaners.

After the 5th or 6th time I brought it by they stop recording mileage.

I'm not sure about their litigious history. Only what I hear from disgruntled customers.


I am in a unique boat but if I say hey pay off the note give me what I would buy with the money you give me and throw some accessories on it for me.

 

And yes those are my complaints. I'm not asking for much.

 

No I don't think you are given the situation but I think you may be disappointed in what you recover. I did not mean to get off topic, but since what truck you get sort of depends on what you awarded in judgement, unless you trade your Tundra in at a loss, I was interested in what your expectations were.

All things considered in your OP, I'd go with the V6 Access Cab... I think a supercharged 4-cylinder may not be the best fit given what your use will require.

Don't let these jackholes take you for a ride. Consult a lawyer. That photo of your truck going through the toll booth after midnight speaks bounds. Don't let this shit go man, if you just let it go then they'll do it to someone else.

 

Good luck with your situation with the dealership, from your description of the uses of your truck, I think a full size truck would suit your needs. A lift and 35 in tires, is not going to make your truck economical by any means at all, keep your truck stock. Maybe a 3/4 ton diesel truck would suit your needs for the ranch and commuter vehicle.

I grew up on a cattle ranch, and we always had an Toyota 4 x 4 for doing things around the ranch, it was a bit more economical. We also had a full size truck for pulling trailers and hauling heavier stuff. The Toyota suspension will not hold up to heavy loads over time, your rear leafs will be frowning.

 

Wouldn't addaleafs or airbags I've seen available foot the bill?
Well the full size I have is a double cab 4x2 with 4.6 I need a 4x4 period.
