    The most important thing is everyone involved seems to be ok. I am very happy to hear that.

    I'm sure that frame is toast. So i don't see why it isn't totaled either.

    Glad to hear everyone's ok! Sorry to hear about you're truck, it's a shame it had to go through this. I'm not surprised it's not totaled off, I've seen lots of these hits before. A big thing is how far the back the damage goes. You pretty much need to roll our trucks over to tl them. Good luck with the whole process.hopefully it's not too stressful for you

    Remember that since it is someone elses insurance company you are not bound by any contractual terms. This means you should be nasty aggressive with them. Most all insurance companies have provisions in your policy saying you can't recover loss of value, for example. You definitely want to get loss of value money here. Your truck will have an accident on the carfax and will never be "the same." I really think you should insist on $4k in loss of value money. In reality the truck is worth less now and you should be compensated. Tell them you are going to hire an attorney if they don't agree to pay you this money--they will pay.

    i wanna know how 13k in damage isnt totaled.
    i feel much better dropping 30k on this truck seeing things like this though.
    im usually a pretty nervous guy in 4 wheels.. for some reason im still invincible on two. (i got hit on my bike three years ago... figure that one out.)

    Totaled means the vehicle can't be repaired or that the repair cost exceeds a certain threshold amount. In most states this is around 75% of the value. When you are talking value in terms of a vehicle being totaled you are talking about replacement value, which is probably mid $20k's for this truck. Replacement value is probably nada retail or kbb retail. I am not saying this is what the insurance co will offer you right off the bat, but what they are going to be figuring on paying out. So there is no way $13k in damage will be considered totaled on a 2009 Tacoma DC. But, depending upon how aggressive you get with the other person's insurance co it could change things. For example, if you let them know you are going to be a complete pain in the ass about having things done perfectly and going to insist on loss of value you may get them to total the truck out and give you nada value plus sales tax (they have to give you sales tax). You just have to remember you are in the driver's seat. They are legally bound to place you back in the same position you were in before the wreck. This means a truck that had not been wrecked. If this means fixing it then you must be compensated monetarily for the lost value that can't be repaired (the fact the truck has now been "wrecked"). They will tell you no upon first request, you just have to tell them it is going to be your way not theirs. I once had a drunk jack ass t bone me in my pride and joy (restored old Bronco). Not only did this leave me upside in a ditch hanging by my five point harness, but taught me a valuable lesson about dealing with insurance companies. Long story short I ended up getting double for the truck what they offered me at first bat. Of course every time I insisted for more money they said "no we can't do that," so I would tell them they did not have a choice as I was going to get that one way or the other because that is what I was entitled to. Eventually they cave to avoid a law suit. Don't be scared to be a jack ass. The insurance adjuster has to settle the claim and close the file. So don't be afraid to get nasty and make demands. You will eventually get something fair.

    Not to be a jerk (as I totally agree that you should get exactly what you're entitled to) but this is the reason that insurance companies charge out the ass, and turn into real pricks when dealing with claims.

    Not sure I agree with that, They are jerks because they are in the business to make money and because there are so many fraud cases they have become very stingy with their profits. This is a legit claim and he is entitled to get back the TRUE value of the truck. The other driver was at fault and it is up to her insurance to pay out...then raise her rates/drop her if she is not a good driver.

    I went down to the shop to get the estimate and get a better look at the damage and its not as bad as it looks. Of course there is the bumper, hood, front fenders, radiator and a/c. But the funny thing is that the other car was pulling a small utility trailer that whipped around and smack the side of the bed, denting it and busting out my tail light. Its amazing how much the bumper absorbed all the impact and just snapped off inside leaving no damage to the frame rails. Oh an I snapped a lower control arm on the driver side to.

    No you are confused about what I am saying. I am not implying the OP try to get a bs settlement against the insurance company for which he is not entitled. You are referencing the need for tort reform in our legal system which is partly a result of insurance companies settling frivolous law suits as it is cheaper than to pay the legal fees associated with a trial. What the OP needs to do is make sure he comes out even with where he was before. There is no way he can come out even unless he gets a real replacement value for his truck or loss of value money. Believe me, insurance companies don't "charge out the ass" because they pay people what they are entitled to....next time you see a plaintiff's attorney's face on the side of a bus or on a billboard promising to turn your wreck into a check you will know why insurance companies charge so much.
