dead beat renter

    So I have this house im renting to my sister. Her friend wants to move in, I say it's a bad idea but go along with it.

    Friend moves in before a) talking about it with me b) signing a contract c) paying rent/security deposit.

    She signs lease for 4 months @ 350/mo + 525 security deposit + 10/mo for her dog. Well long story short, she pays a total of $240 over like 3 months. She finally moved out and left her stuff. I took her stuff to my house so it would be out of the renting house so I could get a new tennant in. I finally leave a message on my sisters facebook that I am throwing it out and all of a sudden I get a message from the dead beat renter not to. The following is the actual messages back and forth so far. I kinda chuckled.

    Her: do not throw my stuff away.

    Me: What should I do with it? By law I only need to hold onto it for a month, which it has now been 3+ months. If you read your lease agreement it is stated that anything left becomes my possession if unclaimed.

    I am willing to work with you, but you need to fulfill your end of the lease agreement then. I could have had that room rented out making money, but instead I got shafted by helping my sisters friend out. According to the lease agree you signed on 9/7/2008 you would pay $1400 + $40 for pets for 4 months of living, plus a refundable $525 security deposit. I would have obtained $300 of your security deposit because of scratched floors and faded finish from dog urine. That is the cost to refinish one room. Late fees would account to $72. Total would be $1812. You paid $240, so $1,572. I will work with you and sell you your stuff back for $1,100. I am eating $472 then, which is quite a lot.

    This is not illegal because a) you broke your contract b) the possessions are mine since they are covered under the abandonment law which states items left for a month or longer become my sole property.

    I have 3 bags of clothes, ur chest, cds, records, and some other items.

    $200 for each bag of clothes.
    $150 for your personal belongings
    $200 for your cds
    $150 for your records and anything remaining.

    This is non negotiable and will be sold to you in that order. I will be dumping or selling each set of items every week in the order listed. If I do not have your first $200 by next friday then I am bringing your clothes to salvation army. We will meet in a parking lot of the lincolnwood police station to exchange so there will be no funny business.

    Do we have an agreement or should I just start tossing the stuff monday?


    Her: hold on to it, give me your number and i'll call you.... and just for your information my stuff wasnt abandoned, you stole it which is by law illegal. also i will not pay for the last week of november because you took my stuff before that. i'll call you, just give me your number.

    just so you know, i'll call my lawyer and see exactly what rights you have that you're claiming


    Me: Is this some kind of joke? I have no idea when you moved out because you never even paid any rent. Also, you had no contact number and refused to contact me. For all I know, you moved out before you moved in and you have no way of proving it.

    Second, I did not steal your stuff, I relocated it to a storage facility so I could get a new renter in, which is perfectly legal. You never asked for it. You never called and said "hey, I want my stuff back", now did you? That's right, you never made any attempt to contact me.

    Guess what else, you signed a contract that binds you to the entire amount paid, not how many months, days, or hours you decided to live there rent-free. Go ahead, talk to your lawyer and make sure you provide him with ALL the details.

    If you rather take this up in small claims court, let me know. Be forewarned that you will be sued for the entire amount owed which is $1,812. My phone number is on the contract, you can use that one.





    This should be fun.

    Man, that's a tough deal.

    I know AZ has a nice comprehensive set of Revised Statutes for rentals.

    I have had rentals for years. The more paperwork, contracts, addendems, checklists, etc... you have , the better your ASS is covered.

    trust me, she's not attractive at all.

    i find it funny that i offer her a solution to get her stuff back and she tries to play hard-ball. she has no clue about the law and no money to hire a lawyer. if she didnt drink and smoke so much she could have paid the rent fine. she probably also could have stayed there longer than i let her legally as well. i am not sure on the laws in WI, but i believe you aren't allowed to kicked someone out in winter time in IL.

    she told my sister a couple months back that her dad was mad at me and was gonna come steal her stuff back lol. what's funny is that she doesn't even have the contract anymore, or my address.

    the new tennant is great. pays his bills takes care of the house and is able to put up with my sister. last month he paid next month in advance. why can't they all be like that.

    thats what im going through with my old chevy truck. kid bought it for five grand and it has 275000 miles on it and beat the hell out of it now he thinks i owe him a new lift or buy the truck back.

    i hope so. he seems a little weird, but pays his bills. i keep asking how long he plans on staying and he says a year or 2. he is going to school and i only wanted to rent to college kids so their parents could foot the bill. its way cheaper than a dorm and you get a freakin house to live in. this kid is 27 though and paying his own.
