Speeding ticket advice from law enforcement or lawyer would be nice

[FONT=&quot]I know it’s a little late for me to be asking since I have to be in court tomorrow but I’ll check this site tonight before I go to bed and first thing tomorrow morning. I was issued a ticket for 84mph in 70 and I have a clean driving record prior to this ticket and that would be 4 points on my license. I was advised by one lawyer to see the Officer who wrote me the ticket and ask him to please reduce it to 9mph over so that it will just be just 2 points on my license. I was also advised if the Officer doesn’t want to help me out to ask the clerk for a trial by jury.

The Officer who wrote me the ticket is different than the one who clocked me with radar gun since I’m not sure that is going to make a difference as who needs to be in the court house.

What if the police officer who wrote me the ticket doesn’t show up in court?

Another lawyer advised me to ask to have my ticket changed from speeding to careless driving since it doesn’t carry any points but the fine is higher fine.

Does it sound like I was giving good advice?

Speeding ticket advice? Don't speed.

If you knowingly break the law, you should know and understand the consequences of your actions, and should not complain when you get a ticket. Don't want a ticket? Drive the speed limit. You won't get tickets and your insurance won't get more expensive.

 

In Texas, drivers in your position take defensive driving. If you want to fight it, you may win but you probably won't. You can also hope it gets dismissed if officer doesn't show up.

 

The few times I've been cited, I just lawyer up and they get it reduced to improper equipment. The state isn't terribly concerned what infraction you pay for, as long as you pay for something. They need the money.

Your main concern should be minimizing or negating any increase in your insurance premiums, because that's what'll *really* cost you.

The Lawyer option is obviously too late for you, but you could certainly ask the magistrate for a reduction; I don't know how points work in SC (I'm from NC), but I can only see a reduction helping.

 

not sure how legit this is....but i have heard from more than one person that when you pay the fine, pay a few dollars more than the fine. When you get the difference back in the mail, do not cash it. What I have been told is that this keeps your file open and the points never get posted to your record.

And I bet you'd be wanting a way out of it if you got caught speeding/jaywalking/etc.

Everyone breaks laws, but not always out of blatant disregard to those laws. Never speed going down a hill? I doubt it. Save the judgement for someone else, he's just looking for advice about his situation.

 

This sounds like it could very easily be obstruction of justice...I wouldn't want to be the guy that tries it...or the guy that suggests it on this site.

I'll defer to you for obvious reasons. NC apparently allows this, as well as reductions to lower speed infractions.

But then, we also have Prayer for Judgement, so hell...what me worry, right?

I've been pulled over in 3 different states. I've always asked the officer, when getting a ticket, if there was an option available so the points wouldn't hit insurance. There are differing options in different states, but I've yet to find a state that does not offer something. Generally, it is either paying extra $ and being "clean" for a set period of time, or taking a safe driver course and passing successfully, which is also paying extra $. Sometimes it's as simple as the officer marking something on the infraction to where it won't be reported to your insurance. I have a clean driving record, and I think that is a key factor in being granted such option(s). The extra $ has never been significant enough to not opt for.

 

i got a lawyer and had my ticket reduced obviously too late for your ordeal and i agree everyone breaks the law from time to time without realizing it give him a break.

 

we had an insurance agent in my Law class last week that said that was going bye bye in NC soon, like it apparently already has in some states.
