    The idiot pays for the lawyer either way so he still loses money. But yea lawyers (the good kind) are usually useful.

    Have they told you what the 9k in additional damages is for? I'm no lawyer, but I do know they'll need to provide some justifiable reason for seeking that money.

    I skipped a few pages, so you may be already planning to do this. If it were me, I would get a lawyer, do my best to prove that he was abusing the truck (the wal mart thing), get the mechanic to write in paper that the truck was fine at the time of purchase and provide a copy of the bill of sale stating 'as is'. I'd also consider a counter suit for legal costs (maybe other time and efforts costs).

    Here's what you need to do...make a list of EVERY mod you want to do to your Taco...total it up, and then countersue ASSHAT for at least this amount plus whatever the kegs and gas money are gonna cost us all to come party with you and laugh at him.:drunk: Freakin' sperm burper oughta be castrated. Also, you do know the difference between a lawyer and a catfish right? One is a scum-sucking bottom dweller and the other one's a fish.:rofl::rofl:

    I think that the case is over. I don't know. I skipped a few pages. But, I'm still going to give my .02.

    If you're giving us all the facts, it apprears that the dude is a POS and wronfgully suing you. Even if you didn't have the evidence that you explained, it won't matter. The court system will see that you sold it AS-IS (key words) and they'll find you not liable.

    Redicules! The truck is 18 years old and has a crazy lift with 250+K miles on it. WTF was he thinking? The judge should laugh! i can't believe what we pay for sometimes. That case cost lots of tax $$.

    I'm not sure if I've missed the boat, but if he's lawyered up you need to as well. I know it's not cheap but I've seen too many people get the shaft trying to represent themselves pro se (without a lawyer). You can probably find someone to do it relatively cheaply since its appears to be a simple breach of contract issue and you can probably get it taken care of on summary judgment. I could be wrong, but only an your attorney would know for sure.

    Well, that depends. If the plaintif is requesting 5,000, then the case should be dealt with in small claims. In small claims, neither the plaintiff nor defendent can have lawyers. (At least, that's the way it is here in California and I know it's that way in Texas - I'm from Dallas).

    If the plaintiff is claiming more then 5K, then he has a right to an attorney and so does the defendant.

    In any case, the defendant has a strong case. He sold the Truck AS-IS. It's very important to understand those magical words. The plaintiff can try to sue all he wants, but I highly doubt he will win and that's why I think the defendant doesn't need a lawyer. :)

    I'm no lawyer, but that is what I would do. Trying to help another TW member out. Good luck!

    dude i had to settle with them because our fucking goverment is dumb as fucking shit. they said due to my family owning the business it was under the consumer law and he could of sued me up to 10,000 dollars! so my dumb ass lawyer pissed his pants and gave up and i ended up having to settle with him for $2,500. i hate the goverment so much and these crooked fucking lawyers just out to make a buck. i dont care anymore cause 2,500 bucks is pocket change concidering he probally had to give the lawyer 1,000 or more in fees.. did you notice he went and spent it on a new lift but the dumb shit hasn't relied that it is gonna pop here soon trying to push those 37s and having 295,000 miles on it. i dont care ill just wait till the gopher boys go to inspect it and turn there welfare asses in.
