Employee lunch break legal question

There is a lot of information on the interwebz and I have a feeling that the owner of this site might know how to work it. Yes, TW is cool and he's provided us with that. If nobody asked any questions or for opinions from peers (due to searching the web only) then this site would have no use.

There was a reason that you came here, correct? Surely you've learned from SOMETHING posted here, right? Do you take what everyone says on the net as gold?

Not really! The management and I both have a copy of the contract and are on the same page with most things. I am here in case there's a slip up or if an employee doesn't understand their rights according to contract.

If the boss needs to do disciplinary action, he will usually run it by me first and sometimes we have a discussion to avoid that, turning it into a problem solving meeting with the employee.

They do! But it's more of an education thing. Granted, sometimes their rights HAVE been violated but often times it's not on purpose. I have been able to bet restitution pay for those that have not been given hours according to seniority. I am the employee advocate.

 

I'd probably get fired for telling them to get their worthless butts back to work and quit crying

LOL! New Mexico employers aren't mandated to provide a break of any kind at all no matter the hours worked! (However if they do provide a break that is less than half an hour long, the employee must still get paid for it.)

The general rule where I work is that we get a 1 hour lunch break if our shift is 8 hours or longer, but when we're busy, even that might not happen. I've worked from 7am to 6pm (non-stop) without a lunch break, and it is totally legal.

California is for wimps.... just sayin! lol

 

Unless you mean firing my boys & girls and getting Home Depot employees, which I'd like to do in some moments, that CAgov site is surprisingly extremely specific in what I'm able to do. Great to be able to finally read it.
