    raffle law FYI from the Attorney General of Utah


    Raffles may be considered illegal gambling if they meet the three elements of the definition in Utah code Ann. 76-10-1101. To the extent that one of the elements is missing, you probably do not meet the definition. The three elements are:

    1. It is among people who have given or agreed to give
    something of value in order to participate or who are
    risking anything of value for a return or upon the
    outcome of a contest, game or scheme;

    2. There is "an element" of luck in the game, scheme
    or distribution and

    3. Something of value may be received.

    "Anything of value" does not mean just cash or money but could also
    be a promise sufficient to support a contract.

    From what I have read from your post as log as raffle tickets are not sold for cash or a promise to pay later then we are fine however I see a loop hole. If you ask people for let's say a 5 dollar donation to use the porta pot and they receive one raffle ticket pre 5 dollar donation then you are good to go. The money is not for the purpose of gaining something kit is being use to pay for a service

    well they made it sound like you need ALL 3 for it to be illegal...if you are missing ONE then you PROBABLY do not apply...i love how they use probably..they gotta leave it open somehow for their personal manipulation...

    but if we keep the donations to BFE and for the facility usage separate, we might be good on the raffle...everyone who attends would be allowed a chance to win for FREE!-ish

    got great news from Olaf at BFE and we're in the clear for most all our worries...

    camping...good to go (just keep out of the tree line on the east side that borders BLM land)
    trail run sizes...keep <20 trucks to avoid permit issues
    raffle...still working out the details on this but no worries on that either

    I guess ill ask the dumb question, do you really think the cops or the state of Utah is going to come out and ask questions about a raffle and who would be stupid enough to tell them hay were selling raffle tickets I know were all law abiding citizens but really the city of moab and the police don't want to mess with off road enthusiast we are the people who make it that they can live there people like us pump hundreds of thousands into the local economy they don't want to run us away that's just my opinion

    with this event growing at the pace that it is...i want to make sure that all participants are covered and not exposed to legal issues...

    would we be fine either way, most likely...do i feel better knowing that we have more areas covered and we're now less exposed to any sort of legal issue, yes..

    from what i been hearing, BLM has been cracking down a lot on off-roaders and their use of the land..so why not decrease out exposure and risks out there so we can focus on having a good time and not skirting the law..

    and when you add in misdemeanor charges and possible fines for illegal gambling, i'd prefer to cover my ass no matter where i'm doing it

    and trail violations i heard could be assessed not only on the leaders but on everybody in the group..so that was another important aspect to have covered..
