    Tell me about these Miranda "rights".

    Miranda is case law, stating that police are required to advise a person of their rights if they are in custody, and being asked incriminating questions by police officers.

    Miranda doesn't give rights, its an advisement of rights.

    I can see the guy`s point, he was letting them know that basically it is a dumb question to ask someone to say they have been drinking and incriminate themselves

    The funny part was that he got more info from the cops than they got from him

    Im not a cop hater at all, I appreciate all of the honest Leo`s that go to work to do a good job for the community

    I say honest because I know of some crooked ones that dont have a job anymore

    Leo`s put their life on the line everytime they go to work, they never know what is gonna happen at every traffic stop, they dont know when they leave the house if they will be returning home that night in one piece or returning at all

    To all Leo`s, keep your nose clean and do the right thing

    I'm all for defending our rights, but I do have to say that our founding fathers didn't have millions of cars on the road, terrorists flying planes, nuclear bombs, technology or alot of the things we have today that can be used for positive and negative results. I don't like my freedoms to be infringed upon, however, I'm also of the midset that driving on a road is a privilege, not a right. That is why I have to get a license. It wasn't supplied to me at birth. I have to have insurance and be responsible. If the cops spend their entire evening out there questioning people and they find just one guy that smells like a can of Schlitz malt liqueur, then I'm ok if I have to sit in line for 5 minutes. My, and my family's safety are more important to me that those five minutes and since I did nothing wrong, I have nothing to hide. They have a job to do, and I pay them to do it. I expect them to be as proactive as possible to protect me on my daily commute. I'm NOT saying they should execute searches illegally. I AM saying you should show respect and that you should be caught and tossed into jail next to bubba the ass humper if you're over the legal limit. How many times have we all heard about the guy with 4 DUI's that killed a family of 4 in their minivan while driving home from the local pub? I think the cops performed admirably in the video, and the guy exercised his rights, dickhead or not. The funny thing is that I think he showed his sobriety by acting as he did... He wasn't snotty, didn't talk down to the officers or berate them about his rights. And the cops probably based their decision on how he acted calm and asked questions without slurring or reeking of alcohol. Both sides accomplished what they set out for.

    As for the TSA and screening me.... I don't care if my bald, fat ass shows up as an X-ray pic on Facebook. If I'm going onto a plane, I want everyone to go through one of those machines that can pick out a wart on your ass. My safety depends on it, and again... Flying in a plane is NOT your legal right, it's a privilege. That's why poor people can't fly. It's too damned expensive. If it was a right, we'd have free boarding passes for life stapled to your government issued social security card.

    I like the rights and freedoms I have, but I'm also able to be flexible. Certain things people claim as unconstitutional are things that the forefathers never could've foreseen.

    I'll take you at your word skygear, and that's quite a story. Sounds like you got the worst kind there. If this had happened to me, I would make that officer's life a living hell... subtly at first... but over time with the right information regarding his whereabouts, his habits, and his weaknesses, he would learn the hard way.

    Do you naturally assume he was copping an attitude for stating he wished to remain silent? It's his right to do so... is a citizen unable to assert their rights in the presence of a LEO? Just because this guy has a badge and legitimate authority does not make him all-powerful and unaccountable. What, an LEO speaks and he must answer? Can someone please remind me what country we still live in? If he wants to say nothing, he has the right to do so and should be free from harassment. If the officer believes he has committed a crime, he can detain him but not abuse him for his own pleasure.

    According to Skygear, the officer then proceeded to abuse his authority and harass him for nothing more than asserting his right.

    And that is the problem many of us believe exists today--a decline in respect towards individual liberty.

    Some of the responses in here are incredible. Sure the police are trrying to make things safer. I give them that HOWEVER, we, as citizens have a right to remain silent. Anything that you say WILL be used against you in a court of law. DO NOT FORGET that. The cops are not your friends.
    They are doing their job. Which BTW, once you engage with them and answer their question, usually leads to a discussion. Most people can't keep their own mouth shut, and thus they slit their own throats. Time and again, I have seen their own words used against them in court. If they don't have resonable suspicion, don't make their job easier and your life more difficult. If they don't have a reason to have the situation rise to the level of probable cause. Don't assist them. As public defender, too many times clients' own statements make it difficult to defend them. But hey, I don't always work with the deep end of the gene pool.
    More importantly, I now have a new line of questions to ask a jury pool. There are quite a few of you in here that I would not want on my client's jury.
    And BTW: this is in no way to be misconstrued as providing anyone with any kind of legal advise whatsoever, nor is there to be any misconception that there is any type of attorney-client relationship, period. Just simple observation/experience. BTW (II), I will not engage in a back and forth, this is just the "small print" that we need to cover our asses, as attorneys. (*here comes the flogging*). Everone hates attorneys, so, go ahead, bring it....live up to my expectations.
    Long live Miranda, and your rights as citizens!
