    But if there is an ongoing investigation (which there wasn't in this case initially), couldn't the firearm in question be held as evidence? You don't need to charge someone to open an investigation and collect evidence.

    I completely agree with you on this one. As evidence in an ongoing investigation, it could and should be held.

    The bizarre thing about the situation is that there was no investigation when it initially happened. It explains why it wasn't taken from him, but does nothing to explain why there was no investigation at the time of the murder.

    I am completely baffled by that, too.

    Seems like a fatal shooting in a gated community between an armed and unarmed person would equal Insta-investigation.

    It's my understanding that this was a gated community and that Zimmerman is part of and possibly president of the neighborhood watch program. I would think that would normally prompt some kind of a "Hey, what are you doing in here?" initial contact, armed or not and regardless of the other person's race.

    Did the 911 operator tell him to stay put? Is that outside the context of Stand Your Ground? I don't feel following someone who seems out of place is wrong regardless of what a 911 operator tells you. They don't have any legal authority to tell you what to do. I also don't feel it makes someone a "willing participant". It's still OK to ask questions in this country.

    There hasn't been a trial and that is the only way we'll know the truth. It could have been an accidental discharge for all we know. Zimmerman was found bloodied and beaten so that is a possibility however unlikely it seems.

    I hope that there is a trial and we get to know the full story. I think Travon Martin's family deserves that. I think George Zimmerman deserves that. It's a tragedy when this type of thing happens. Someone could have prevented it.

    I think the political posturing over SYG is ridiculous. If Florida wasn't a SYG state and Zimmerman just grabbed a gun from his sock drawer I doubt would've even made the news. The media smells chum in the water on one of its favorite topics and will do anything possible to blow this story up and sway it whatever direction they choose.

    This is an interesting perspective and potential twist. If it's found to be the case, I would think it would be substantial enough evidence in support of Zimmerman's incompetence to at least have his CC permit stripped.

    I could see accidental discharge resulting in the murder of an individual bringing with it a whole slew of additional charges.

    Well....maybe. But, what would you say if, and this is just a what if-

    Zimmerman, with his sidearm holstered, confronts Martin and asks him why there is a strange face in a gated community. (Assuming he did his job as neighborhood watch and made it a point to know every face that comes and goes.)

    Martin doesn't like to be confronted and jumps Zimmerman immediately- before Zimmerman has time to react. During the scuffle Martin realizes Zimmerman is armed and goes for the gun. In the process of the 2 men trying to maintain or gain control of Zimmerman's weapon, it goes off and Martin winds up dead.

    Yeah, the guy is a dope for getting close enough for someone to reach him before he can react. But I wouldn't say he's incompetent.

    There is one glaring flaw with that hypothetical -- it's not Zimmerman's job to police the neighborhood. He can call the authorities, but that's where his part ends. Once he attempts to assume the role of the police and pursues, he's the aggressor with no legal support for his actions.

    I don't think asking someone if they belong somewhere makes you an aggressor. If he asked Travon what he was doing in the community that seems fair. If he ran out of his car, gun drawn shouting "Get down motherf*****" then yeah- this one's on him.

    Is it his job? I don't know. I don't live in a gated community. Most likely never will. But maybe that's what you sign up for when you sign on for the neighborhood watch. I really don't know.

    But I can tell you this. I've left my front door in the middle of the night (unarmed) and chased people off of neighbor's property when they were up to no good. I felt it my responsibility to protect my neighbors if I could.

    I'm sure these can be brought up as defense if need arises.

    I think there is enough doubt to be cast as to whether Martin attacked Zimmerman. He very well may have. It is also entirely plausible the the firearm went off in the middle of a dust-up, killing Martin.

    The body of evidence is certainly circumstantial. The best that anyone can point to is the call that Zimmerman made when the police told him not to follow Martin. But that only suggests that he took matters into his own hands. It reveals nothing about how the altercation actually went down.

    Doesn't seem like anyone really knows what went on except Zimmerman, and he's smart enough not to talk to the media. Why the police didn't immediately investigate is beyond me.

    It doesn't look good for Zimmerman, the evidence we see does not cast him in a favorable light. But it's all circumstantial. And until we actually have the full story it kinda seems like a witch hunt. Innocent until proven guilty, folks.

    I think the president is trying to lend an air of calm and a message of "let's look into this more closely before we all go off the rails." There are a lot of angry people staging protests and demonstrations, and I think he is trying to get them to calm down and let the investigation take place.
