Quiting Job

    Hi,

    My wife put her 2 week notice in to her current employer last week. Her last scheduled day would be next Wednesday.

    Today, her work told her today will be her last day of work there.

    My question to you guys is what can we expect her to be paid for? Should she get paid up to next Wednesday, or today?

    neglect, mostly.
    just today as i suspect. a 2 weeks notice is just a courtesy to the employer, it holds no legal . . . . anything. legally, unless there was written agreement when she started the job, when she's not working, she doesn't have to get paid.

    When an employee puts in their two week notice employers often send them home that day so they don't end up tampering with anything.

    That is what I figured. Thanks for the quick reply guys. I understand the whole sending employees home early so they don't do something stupid, just wondering what was legally hers to expect.

    basically that ^^ haha.

    but i think what the OP is stemming from is - since she put in a notice and theyre cutting her short from what she told them/expected, will she get paid for those days. the employer can be nice and pay her those unworked days, but he or she does not have to, and most don't.

    If she is an at-will employee, meaning no contract was signed when hired to guarantee a job at X salary for X years, then she gets paid for just today.

    Anything past that is a bonus and good-will on the company's part per the law. For at-will employees a two-week notice is customary but not required from either party.

    She would be paid up to her last day worked, and owed vacation time (depends on company and how those things are arranged) and any pay held in arrears, as some places of employment hold back pay one pay period (1-2 weeks depending on company).

    Usually they will go ahead and honor her resignation day and pay it out, they just don't want her to do anything with sensitive materials being that she is already quiting. It is easier for them then releasing her early and facing a wrongful termination suit, however that does not mean they won't terminate her or release her with pay. Nothing regulates what they have to do, they just have to be sure and do it in a lawful way.

    I am guessing her employer will treat her like shit and only pay her up to today, even though she was trying to be courteous and professional by giving 2 weeks notice.

    She has been a reliable/responsible worker (preschool teacher) for 12 years at the same school, and I don't think her school is going to bat an eye at her leaving (ie. no going away party, or good luck talk). Fuck that place.

    In my experience, employers will usually honor the 2 weeks and pay through that date. Never worked for a company that didn't.

    What I have seen (and all places have their own ways of doing things), if you are hourly, and they send you home, you don't get paid. If you are salaried, they honor the 2-week notice and pay you through the 2 weeks. Legally they don't have to, but I think it is typically a mutual respect thing, almost like a severence pay when they lay you off.

    My company would probably pay her until the end of her 2 week notice even if we told her not to come back - not required to by law though.

    The good will gained from the other employees would more than make up for the extra days paid.

    She is chaning careers to be a Medical Asst.

    Regarding the pay, it sounds like a respect/couteous/professional thing to do to not burn bridges with anyone. However, the school has been changing management over the last couple years, and they are shysty as all hell. So if they don't 'have' to pay her, I am assuming they will not as I don't see them doing 'the right thing'.

    Don't mean to thread jack, but I got a quick question about quitting a job.

    I may quit my job at the end of this summer. When I do quit my job my boss will probably not work me the last two weeks after giving my two weeks notice. Can I immediately start working my new job or do I have to wait until the two weeks are up?

    Same kind of thing happened to my wife several years ago, she put in her notice and they "released" her that day. They did not pay for the notice period. I was a bit perturbed to, but after doing some research, found out we had no legal grounds.
