    Yeah...Threatened versus threatend to the level of responding with deadly force are two different things. Instigating the situation by stopping and confronting the second driver threw all that "self-defense" mumbo jumbo out the window.

    Everyone was a moron in that video - And I'd say they are all lucky that didn't get arrested.

    Lets not deviate from what is shown in video or what I said. In Texas (and most other places), you are certainly allowed to defend yourself when threatened. The man in the video did not use his weapon to "pursue and engage." His weapon was not drawn until after the other person had supposedly hit him. I never said one car hit the other. As for the rest, the police obviously didn't agree. According to the video, he was cited for traffic violations (just like the person following him in the other car), not arrested for gun charges (indeed, I'm sure the video author would have said so if that were the case).

    Since the guy was supposed already struck once by the other person following him, he obviously did not know he could "avoid the necessity of using such force with complete safety by retreating." Instead, based on what I saw, he used his weapon to ensure the safety of his retreat, which he promptly did.

    Stopping and staying in the vehicle with hos weapon and call police was safe. Driving like a jackass and then getting out to start an altercation was not. Responding to getting hit or pushed by drawing a weapon is not....
    That guy did not make decisions consistant with common sense and/or legal precident.

    Thats the problem. Once your thrown into the whirlwind of the system you're fucked. Doesn't matter if the officer doesn't have the power of the court systems he can still fuck you hard.

    I agree both parties were idiotic but just saying, you get some officers who might jump to conclusions or get hasty about making a very life altering decision. Especially based on a video.

    Yes the courts are there to decide the fate of the criminally charged, but let's face it, it's not a perfect system and it'll fuck your day up if you end up there. I didn't make any attempt to suggest we adopt another... not sure where you pulled that from?

    I simply said that officers arresting on a whim and a small piece of evidence is bullshit and will fuck you hard, whether or not your fate is decided by another system. That's the problem.

    He did more than just "push" the camera. I wonder how you would feel if someone did the same thing to your mom or sister or wife.
