    Multiple states are in the process of written new laws that would prohibit a person from sending a text message or making a phone call to someone they know to be driving.

    They should expand them to fiddling with your phone in general as well. What's to prevent people from saying they were looking up directions or trolling facebook while they drive?

    That would be near impossible to enforce.....How would they even catch you? Have a cop with you when the text is sent and another cop with whomever is receiving the text? Then a phone trace to make sure it was you sending that text to that driver? Then somehow prove you knew they were driving when the text was sent?

    They just made it illegal to use a cell while driving here, so if you get a call or text you just cant look at it unless you pull over.

    Here where I live you can get pulled over for that and I think they can site you now too.

    They are probably going to use it in accidents. They will pull phone records and then try to go after you if you were texting them and they killed someone. Try to make you and accomplice. PURE BS if you ask me.

    Stupid law if you ask me, and impossible to prove. I think some are confusing this with a ban on texting or talking yourself. This is saying they would go after the SENDER of the text message or call. So if I text you and you open the text while you're driving and kill someone they come after me. Completely retarded, especially since I typically don't keep tabs on all people i know to be aware if they're driving or not. How can they prove anything? Are they expecting someone to send a text saying " i know youre driving but im texting you anyway don't crash." Up to the driver to exercise common sense and not be texting or doing otherwise dangerous shit behind the wheel. I had someone cross over the center line today and almost hit me as they at least appeared to be looking down at a phone.

    I absolutely agree with banning texting, but to enact laws punishing people SENDING messages is ridiculous.

    Wouldn't it be reasonable to just say yeah I knew he was driving but I also know it's illegal for him to check texts so he should have after he got to his destination. . .

    All of you completely missed it. It says if you are the sender and you KNOW the person is driving. Lets say someone leaves your house and they are on the way to pick up drive thru, if you call them because you want to change your order do you know they are driving? YES. Did you text or call knowing they were driving? YES. That is the point. Not saying its right or not but that is what they are getting at. You are knowingly distracting a person trying to drive. Not because you send a text and the person got in an accident. I agree it would be hard to prove I knew unless the person just left my house

    Now who says I didnt send the text thinking that the person would look at it as soon as they get to a safe spot to pull over or park? I cant control stupid people

    The whole idea of texting is to be able to communicate at your own pace, right? If I'm busy doing ANYTHING and I know that I have received a text, I don't drop everything and stop what I'm doing because of it.

    This should be messing with any gadgets, not just phones. I see people messing with their iPods looking for music while driving, that should fall under the same laws as texting if you ask me.
