I really think it should be illegal to do anything in an automobile except drive...

    What if we compromise, it is not illegal to use your phone or eat, but if an accident or you are even speeding and the cause is deemed to be because of set list of wreckless behaviors, then the penalties are much stiffer? Similarly to robbery and armed robbery.

    It's always entertaining to watch people talk about the average person who texts and drives with such low regard, and then talk themselves up about their ability to multitask and how they can responsibly text, drive and eat at the same time. Do you really believe you are an 'Above average' person? Believe me, every one of the texters on the road feels the same way, even 16 year old girls.

    Freedom in this country is not limitless. You can enjoy your freedom until it gets in the way of someone elses. Driving distracted can easily take someone's life and I'd say that's getting in the way of someone's freedom.

    Sounds counterproductive to give a penalty after a disaster occurs. I mean an accident doesn't always end up a nice simple fender bender, it could end up taking someone's life. People tend to not realize cars can be weapons and you must be incredibly responsible when behind the wheel. Giving a penalty after you got into an accident wouldn't stop you before you got into one. If anything, I'd assume the trauma from the accident might stop someone from texting after, but there would be nothing to prevent him from texting in the first place.

    I never said a disaster, it could be a minor fender bender; but that is exactly how penalties work. You don't get a 2 minute minor for hooking because you thought about doing it. The penalty comes after the infraction, and depending on the severity it can always be greater. Just like my robbery example, if it is done with a deadly weapon the penalty is much greater. Doesn't mean you outlaw guns or the use of them, you outlaw the use of a gun when used for committing a crime.

    $250 fine for using a phone while driving would be a good deterrent , no ?

    Because the effects of using a cell phone while driving are the same as being intoxicated, the penalties should be the same as for drunk driving.

    Going to jail and losing your license for a year would be a deterrent. Plus the fines, of course. And riding your bike to work for a year is good excercise.
