My fiance's sister is being stalked/harrased by a potentially violent kid

    Thanks for the replies guys and gals. First off I am in now way saying I wish to harm this kid. I just want to know what rights I have if he comes around in order to protect my family which is not legally my family yet. I am a very christian person and would only use force if my family is in physical harm. He has come to the house at least 3 times before and I am just worried he will come back with intent to harm someone. The police know about the situation but I am worried about that 5 min window between when the cops are called and when they get there.

    I"m wondering if you can call the PD and let them know of your concern, that the guy has violated the restraining order and if they can make a house call to this guy to verbally remind him of the court order.

    That might slap a little reality into his mind.

    What does the dad have to say about this? Why is he harassing your sis in law?

    Ditto. Use the amount of force to stop the threat. If your life or those with you are in jeopardy, don't screw around with trying to go for the arms or legs. Don't make his decision of breaking into your property any more difficult. You might as well go with less-lethal options like shotgun bean bag rounds if you have that thought process, or even pepper spray.

    Agreed! Be prepared to fight, if he has a weapon, then 1 up him. If it's a small knife, don't grab a gun, grab a chair and disarm him. Just be prepared if he does show up with a pistol. Enjoy it tho, not much enjoyment with your index finger moving 3mm.

    I'm not familiar with MN's castle doctrine, but in general, you may do no more than you need to defend yourself or another person if you have a reasonable belief that your life or the life of another is in danger.

    In general, you may NOT move to confront an individual even if they are damaging property. You must take defensive measures, and wait until they present a clear and present danger.

    At that point, deadly force is permitted in most states.

    Some states, such as Texas, allow for the use of deadly force to protect personal property, but there will certainly be a court battle over it, but in a reasonable self-defense shooting, charges are not usually pressed.

    Just remember:

    "I believe an intruder may have been shot, please send an officer and an ambulance. I am 6'2" blond wearing a green shirt and jeans, I will be waiting (wherever you will be waiting)"

    You don't want the responding cops to mistake you fore the bogey or an accomplice (they likely won't know whether it's a burglary or not).

    Immediately upon their arrival, unload and surrender the gun.
    Say NOTHING MORE (goes for her too) than "I was in fear for my life, I'm pretty shaken up right now and would prefer not to speak, but I will be happy to answer any questions tomorrow after I speak to my attorney"

    Do not consent to a search of the home, your vehicle, or your person.
    If they express concerns that there may be an accomplice, explain that you know he is alone without giving details.

    Only if you are trained in hand to hand combat.
    If you are not, that is a very good way to become coyote food.

    If he has ANY weapon, is making aggressive moves, and is within 30ft unobstructed, it's time to draw AND FIRE.

    Do not "shoot to kill".... do not "shoot to wound"
    You are shooting to stop an immediate reasonable threat. Nothing more, nothing less.

    That is going to open a can of worms in court that you do NOT want opened.

    Even trained cops do not use less-lethal measures without fully armed and ready backup.

    Things happen quickly and if he does not respond to the bean bags or pepper, you will likely not have time to switch to something more lethal.

    Except for the family of the bogey who will swear that he was such a good boy and was a little "slow" but never ever ever ever hurt even a single insect and you are a crazy wacko gun nut who believes that all sinners will go to hell and it is your God-given duty to make sure that happens.


    Even a fine young Christian with a spotless record can be painted the bad guy by civil tort attorneys.


    There WILL be a lawsuit against the shooter, regardless of the outcome of any criminal proceedings, unless the bogey's family truly has written him off.

    Know of a group of Marines, or Navy Seals that like a nice card night? Prob is, when someone tapes 1 Marine or Navy Seal entering the fracus......the whole fight is over in about 3 video frames. Not much for You Tube fodder, but sure makes one smile.

    ...ok, a lot of BS being spouted around here....

    1) i agree w/ rich's assertion of self defense doctrine and zipping your mouth w/out counsel present...

    2) all this talk about "taking a leg out", etc,... is really bad advice for a number of reasons, but in general this is the scourge of hollywierd/entertainment industry fairytale stunts, i.e. BS. this isn't easy, let alone feasible, in the real world... more than likely you are moving (perhaps erratically), ..the target is moving, throw in stress/fear, and the difficulty w/ aiming a firearm under these conditions (including short sight-radius weapons like pistols), perhaps bad lighting (or darkness) - and you'll understand why the professionals are trained to go for parts of the body w/ the largest area presentation... ...and if you don't believe me, take some defensive firearm training courses, especially force-on-force airsoft, etc...

    3) most states don't have "registration" of firearms... not sure about the OP's state...

    4) castle laws do generally allow folks to defend themselves w/ less peril of being charged or sued... however, one should know the "whats" and "wheres" of how the law is applied in their state/locale... some states, unfortunately, don't have castle laws, so the victim must take into account the "conditions" required to "validate" lethal force...

    TRAINED to restrain him?

    Order him to immediately LEAVE and call the cops.

    His next moves determine your next move, but attempting to restrain anyone who is potentially violent is the dumbest thing you can do.
