My fiance's sister is being stalked/harrased by a potentially violent kid

    Update for anyone who cares...

    I went to the cop shop today and talked with an officer. I told him my concerns and let him know I was going to be staying at the house and was prepared to use force if it came to it. He was very understanding about the situation. They will be sending patrol cars over there frequently and will be keeping a close eye on the situation. The kid is up for 2 felonies and could get up to a year in jail for vandalism and stalking. Also, If he violates the restraining order he could face up to 10 years in prison. I will be putting up a trail cam soon at their house and will check up on them frequently as well. Apparently his parents are shipping him back to their home country in Africa but who knows if that is true.

    Couple of questions here,
    1. Why have you let this go on for a year, Someone fucking with my family like that for more then a month is getting there shit checked up.
    2. Has there been a restaining order placed between the sister and this stalker guy?

    Now, Let me say this if this kid steps on your property and presents himself in a threat in anyway you are allowed to take deadly force, If you are going to bring a gun though i suggest you really think about it. Are you ready to take the life of some dumbass 19 year old that is mentally unstable and probably needs serious help? Just remember two things, You pull a gun you always have to be ready to use it and also you have to live with the end result for the rest of your life man so think hard. Killing someone isnt as candy coated as the movies make it.

    So maybe you just take the high road and call the cops or speak to his parents or even him to his face and put the fear of god into him for fucking with your sister?

    Okay, your comment really bothers me. If you don't truly know what you can and cannot legally do, why are you going over to "their" house to act like some kind of third-party vigilante? That's a darn good way for you to end up in jail with no way to protect anyone.

    Anyway, to answer your question specifically, no, you quite obviously cannot just do as you please just because he (restraining order or not) shows up on the property. In any case, you cannot use lethal force unless a life is threatened (great bodily harm or death). Likewise, you can't use physical force other than to defend yourself or another from physical force. He can stand in the yard, driveway, street, or whatever, and scream, shout, cuss, or similar, all he wants. Any reponse to that must be by the police.

    If he attempts to or does enter the home, your rights vary greatly by state. Again, you may be restained to not using lethal force unless a life is threatened. I strongly suggest checking the laws within your state, remembering that you are a third-party visitor, not a resident, of that home. As a third-party to the situation, your rights may be even more limited.

    If you really want to do this family any real good, I'd suggest working on a plan in case he does show up - retreating to a safe room, urging them to be calm, having cellphones handy to call police (from that safe room), rehearsing what will be said to the police, and similar. In the meantime, you can report what he's doing so they can relay that to the police. By the way, if you do go outside (not a good idea), drop any weapon with your hands up as soon as police arrive to avoid being mistaken for the perp and shot.

    I can tell you that if my family was forced to live in constant fear such as this, I would handle this situation a bit differently... nothing I need to go into here. Those who truly love their family would not let them remain at risk night after night, day upon day. How many months would you let then live this way? Years? At what point do you say enough is enough? When some of you say you would do anything for your family--would you--really?

    OP, this is not yet your family, so maybe you don't have that bond established yet. Be careful. Keep the police informed and be prepared. BTW, where is the "Dad" in all this? Does this girl have a present father? If so, why hasn't he dealt with this waste-of-human-existence?

    BTW, OP, did this guy's parents ship his criminal-ass back to Africa yet?
