Oh, so you're saying I don't truly love my family? Give me a break. What good are you going to do for your family if you're dead or locked up for years? In situations like this, it's time to use your head, not testosterone or bravado. For everyone's sake. My family's short and long-term safety and security, not my firearm, is always the very first thing on my mind. I plan to be around for a very long time to provide that.

If some nutcase truly is stalking the sister of the OP's girlfriend, the family alone needs to deal with it. Bringing in a gun-toting third-party (who may be more interested in trying to impress the girls) is not a good idea. At the very least, it will escalate the situation.

If it includes murder (as you're hinting at), absolutely not.

Everybody has their way of dealing with things.. But think about it, let him make a move on you first, so when you attack, it's self defense on all parties hurt. If its your property, your always welcomed to shoot, but just remember, anything above the hands, is murder... Below, would be considered. Misdemeanor... So you got a lot of options here lol... Multiple pitbulls lol... Silver strain, or..... You can always teach her how to use a taser.... I was stalked on multiple occasions... But it's up to the girl to take motivation to its meaning... Flip the script on that dumb ass.... What goes around, may come around just as bad... Tell her to man up, grow a sack for just that moment... If he threatens to kill himself, give the go, there's nothing worse, then a man hearing a fearless women.... When it comes to idiots like him.... He smells fear and he loves it... Tell her to stand her ground, no fear!!! No games!!!! She's only helping him by showing her weak side.... Pain is weakness leaving the body... Something I learned with my fellow Marines as friends....

Where the hell did you hear THAT bullshit?

That is incorrect on every level in all 50 states.

If you believe that your life is in danger, or the life of another, homicide is justifiable. They do NOT have to "throw the first punch" or make the first move, beyond whatever "move" is needed to make you feel genuinely threatened.

And you are NOT "always welcome to shoot" when on your property.
In California, signs of forced entry are an "affirmative defense"... the law presumes that forcible entry puts you in a situation where you are in fear for your life... but that's as far as it goes.
California does not require you to retreat in your own home. Some states do.

    Not for my wife.

    Legal prebans for her 92FS.

But that target was from my 1911, so in any state it would have been 6 reloads ;)

I can guarantee that none of what you wrote is in the California Penal Code.

It may have come from something that somebody wrote, and if that's the case, I would recommend that you line your catbox with it because that's what it is worth.

"Below the hands = felony, above = misdemeanor"??????
    That's just asinine.

Either way it's still dead wrong and extremely bad advice.

You're saying that if you shoot someone in the leg it's only a misdemeanor?

Ya... that book should be burned.

Being prior service and a country boy here in Virginia. I find when the hunter becomes the hunted...it puts thing in a whole different light. (we have alot of varmits here) A law enforcement friend told me they can't testify in court when they're dead.

Well, good, the question becomes, does he go back to Africa on two feet or in a box? Good work, the cops know the idiot and they know that you will use force to defend the family if needed. So they will not be surprised if they get a call that you had to center-mass his ass.
So restraining order is good to get the ball rolling if he comes near the house. The call should go "I have a restraining order against Mutumba here and he's acting strange, i think he might get violent, iif he tries to get into my house I will use deadly force to defend me and my family, you have a copy of the order on file, get your asses over here right now!"
See? You have given all the pertinent info quickly AND help to clear yourself in case you have to shoot him.

Now the key is, IF you have to use force, you MUST do so in a manner that makes it look legal, chasing him down the street with a snub-nose 357 and putting hollow-points in his back is not legal. Putting three in his chest because he kicked in the front door with a knife in his hand is. The bigger the knife, the better and not one from your mother-in-law's kitchen set and make sure that only his prints are on it. because this turd has a record and because he's already a felon and because you already got an RO and you told them in person, they will want to help you clear this shooting, the way they see it is that you did them and the rest of society and the US government a huge favor.

You set the table, let's see if the asshole comes to get some.
