The difference is one doesn't violate their constitutional rights and the other does.

Once again, I think you and the other person need to look up the definition of profiling in the legal context.

There's a big difference between what "profiling" we do each day and the profiling a LEO can do.

If I profile someone when I see them that's all I can do. Make an aussumption based on what I see, but that's it.

A LEO on the other hand could profile someone and then pull them over, administer a FST, and then charge them with DUI.

 

Wait really? Haha I didn't even know that. Got a link to a list of states with those exceptions/lack of official laws? I have a guess as to which ones don't...

 

I have heard some states have special drinking regulations for underage people as well. I don't know any specifics though.

The Maryland Underage Drinking Prevention Coalition (MUDPC) summarizes the provisions of the National Minimum Drinking Age Act of 1984 as follows:

“The legal age for alcohol in the USA is 21 years old. The National Minimum Drinking Age Act of 1984 required all states to raise their minimum purchase and public possession of alcohol age to 21. States that did not comply faced a reduction in highway funds under the Federal Highway Aid Act. The U.S. Department of Transportation has determined that all states are in compliance with this act. The national law specifically prohibits purchase and public possession of alcoholic beverages. It does not prohibit persons under 21 (also called youth or minors) from drinking. The title of the legislation itself is clearly misleading in that the National Minimum Age Drinking Act doesn’t prohibit drinking by persons under the age of 21 (so-called “underage” persons) nor does it require the states to prohibit such drinking. In addition, descriptions of the law contribute to the false belief that it does. So Federal law only prohibits minors from purchase and public possession.

That's not true. The National Minimum Drinking Age Act of 1984 only withholds revenue from states which allow the purchase of alcohol by anyone under the age of 21. It does not "outlaw drinking under the age of 21," as you said. Your other comment is wrong as well, but, in the interests of avoiding a long argument, I digress.

 

There is no constitutional right against profiling. The courts have only addressed racial profiling (assuming possible guilt based solely on race), not profiling in general.

Wikipedia has a pretty good page listing the various drinking laws in each state. Absent that or another site, you'll probably have to look up each state individually.

 

Purchase and public consumption. It's a legal loophole setup by the federal government. If you get caught in public underage and you were drinking, you'll be charged.

If you're caught DUI underage, you'll most definitely have the charge of underage DUI (even though it's not technically a crime to consume it, it is a crime to be in public).

But I'll give you that. It's always been illegal for me because of the military.
