    It's California.

    4473 allows "Rifle", "Handgun", and "other"

    Spade-stocked, pistol-grip shotguns, stripped lowers... they are all written up as "other", and since BATFE's feeling is "once a rifle, always a rifle", you are clear in building an "other" into a pistol, or even an AOW.

    California's DROS software includes only "long gun" and "handgun"

    It's good in that a spade type "long gun" is not a rifle, therefore is exempt from California's assault weapon laws. It 4473's as "other" but DROS's as "long gun"
    It's bad because we can't buy a stripped lower and build it as a handgun.
    Two reasons... #1 - It is DROS'd as "long gun" which makes it a SBR in the eyes of California if the barrel is shorter than 16".
    It can't be DROS'd as a "handgun" because of our "not unsafe handgun roster"
    We do have exemptions for dimensionally compliant single shot, as well as single action revolvers... but the stripped lower qualifies for neither.

    Actually the excise tax is a federal tax that's on all firearms to the manufacturer of said firearm. You as a consumer doesn't see it because the manufacturer was charged it and rolled it into the cost of the firearm.

    I'm also not so sure about the you can't dros a pistol frame because if that was true then how can gunsmiths build you custom pistols from a frame up build? This one based off of your information has me curious.

    Btw ARs have all their own rules like you guys stated above then the rest of the firearm world. It clearly states in the ATF regs that a gunsmith can assemble a registered receiver/frame at the request of a customer and that's not manufacturing so an 01FFL is fine however if that same person assembled a receiver/frame for sale prior to request its manufacturing. No where does it state this doesn't apply to an AR but its expected according to several ATF inspectors. Different story if the customer supplies the lower though.

    A smith can not, but an 07FFL can.

    The problem is the roster.
    And in California, a truly custom pistol can not be sold to a non-exempt person unless the build itself is also roster-exempt.

    To be roster-exempt, a handgun must be either a single action revolver, chambering 5 rounds or more, with a barrel length of at least 3".
    The other option is a single-shot.
    The single shot must be furnished with a zero-round sled locked in place (not unlike a bullet button), and the minimum OAL must be 10", minimum barrel length is 7".

    The most common procedure is for the 07 to assemble the gun with a mag-block bolted in, and a 7" barrel, or whatever is needed to bring the OAL to 10" if the 7" is not enough.
    You should see a single-shot converted LCP... fucking goofy looking!

    After taking delivery, the customer has the choice of having a smith, or they can themselves, convert the gun into a semi-auto with the proper barrel.
    Normally, the conversion parts are "sold back" to the 07.

    In California, you can't just walk into a shop and buy a turn-key custom 1911 unless you are a cop.


    We also can't have the Judge. California considers it an SBS... yet the Circuit Judge is not. Go figure.
    But... there are a couple of shops that will configure the Judge, or a short-barreled Saiga-12, as an AOW.

    Well maybe that's why. I'm exempt and can buy off roster handguns. Not talking AR pistols btw.
    Custom was too costly anyhow I just had my 1911 worked over and happy as can be.

    Be careful with that, we see gas ports on M-4s/ARs keyhole pretty often from tracer fire. eventually you have to replace the barrel and gas block.

    In reference to the gas port, I would assume he means elongation and erosion (which will reduce your gas pressure).

    WRT to barrels and target impact, it is a reference to the bullet hitting the target sideways... it's tumbling in flight.
    It is a symptom of instability.
    The cause of the instability can be a number of things.

    Most common on vintage or C&R guns is that the barrel is simply "shot out"... the barrel has been worn to the point that the rifling is no longer properly gripping and spinning the round.
    Sometimes the wear is only near the muzzle and the barrel can be saved.

    More common on a newer build is shooting ammo that is too long (heavy) out of too slow of a twist... a 5.56 1:12 twist with ammo heavier than 70gr will likely keyhole. A 1:9 twist will handle everything except for the 85gr tracers... you need 1:7 for that.
    Most competition barrels are 1:8.

    For any pistol we build, which is few, our customers DO see it because we explain it to them. Only once the pistol is built, with all parts paid for in advance, do we charge for DROS and excise tax. Essentially, we build the gun, customer pays all fees and taxes.

    All I'm saying is you can't just walk in and ask for a lower to be DROS'd as a pistol. We won't do it. We have to build the weapon, then DROS it as a pistol with a single shot exemption. In CA if you take a lower that you picked up and then just build it up as a pistol, you're going to essentially be building an SBR

    Interesting thought..... Would this be workable?

    I walk into your shop, wanting a stripped lower cleared for use as a pistol, but have not decided what configuration I want.
    Under agreement (written or otherwise), you build an AR pistol, and on paper, sell it to me for $900, then, again on paper, I return the upper, LPK, buffer, etc... for $700.
    Now, in actuality, I understand that you do have to physically build the pistol and it must be in roster-exempt form at the time of pickup, meaning "your" conversion parts are tied up for 2 weeks. I was using the term "on paper" meaning avoiding an actual cash transaction of $900 and another of $700.

    Anyone know when bcm or any other good 20" barrels are going to be back in stock? I've been looking for awhile and whenever they do come back they sell out before I realize they are in stock.
