    2 years ago I was arrested for being drunk and eating a hamburger in my drivers seat cause I wanted out of the rain. Charged with a DUI so I've been fighting it obviously and it all boils down to today.

    WHAT IS MEANT BY "CARE AND CONTROL"?
    A person may be in care and control of a motor vehicle if the person has the ability to set the vehicle in motion, or where there is a risk that the person could put the vehicle in motion either on purpose or by accident and become a danger to the public.

    If someone is found in the driver’s seat of a motor vehicle, care and control is presumed unless it can be shown that he or she did not occupy that seat for the purpose of setting the vehicle in motion. But, even if the person is not in the driver’s seat (ex: sitting in the passenger’s seat), if it is proven that he or she was using the motor vehicle in such a way that it may be set in motion, that person may still be found to be in care and control. So, there is a danger of being found guilty even if a person is just sleeping in a motor vehicle. It may even be possible to find someone in care and control of a motor vehicle who is simply near the motor vehicle and has the ability to set it into motion.

    I had them turned to accessory to listen to music. Unfortunately the punishment for guilty is same as full blown DUI punishment.

    I think it's one all over the US... One of my kids got a DUI just for having his keys in the door of his car. He was trying to get his wallet to pay for a cab.

    Yeah, it's a little ridiculious I think, especially in that circumstance. I think it boils down to intent; putting your keys in the door/ignition implies intent to drive.

    Had a friend get nailed for OWI because he was passed out in the drivers seat with no keys in the car. The law in Iowa says that if you have Intent to drive intoxicated then you are guilty. They said he would have driven if he had the keys, therefore showing intent. He tried to fight it and still lost. If he had been in the passenger seat or back seat he would have been fine, but by being in the drivers seat he got fucked.

    In NJ keys in the car anywhere and your booked.

    To date in NJ only one case has been successfully defended and that guy had his car running in the bar parking lot and was sleeping. The only reason he got off was due to the winter temp being below freezing. He claimed he needed to have the heat on to survive the night.

    Agreed. I don't think that me getting into my car after drinking should be an instant DUI. But what are they going to do now that you don't have to have your keys in the ignition on a lot of cars to drive? Erica's Jeep is push button. No keys needed.

    He was found guilty. Lost license for a year, lost a stripe and was kicked out 2 years later when they did force shaping.

    A man and his wife go to their weekend getaway in the mountains where the husband likes to fish and the wife likes to read
    the husband came home early one day from fishing and went to bed
    the wife decided now would be her chance to go out on the boat and read
    so she did
    she didn't know the lake very well so she just layed anchor anywhere and began to read
