    ...based on the article, i don't see where there is any "discretionary measures" to this ordinance - seems to be a blanket "ban", simply based on dwelling construction/layout...

    ...as to your last statement - you are essentially arguing for gov't to impose one's "morality" on others...

    Because there is no guarantee. I have PERSONALLY been in a couple of apartment complexes where it was apparent there were lots of smokers there. Sure, if you can assure that the smoke will absolutely always be contained to one unit its a different story. But that's not always the case. And you mean to tell me you can't smell someone smoking from 20 ft away? Hell I can smell it from cars in front of me in traffic with my windows up.

    Because homes are NOT airtight. Have a specialist come in and seal every nook and cranny. Install a special smoke detector that automatically closes all doors and windows until it no longer detects smoke and you're free, in my mind, to smoke in a multifamily dwelling.

    this ordinace doesn't appear to grant discretion to cases where the smoke is contained... rather it appears to be a comprehensive, and ex-post-facto "ban" - a giant overreach...

    Of course it is. I don't want my tax dollars spent on inspecting each and every dwelling to see if it fits a certain criteria to allow you to smoke without affecting others. Lets spend billions of dollars we don't have to allow someone to continue a pointless habbit that harms others. If smokers wanted to pay for an inspection like this themselves, i'd be all for it, but the second they smoke with an open window and it drifts into a neighbor's they should lose their right. Just like the second you accidently shoot someone you lose your guns.

    I really don't see what the problem is. You say as long as the smoke is contained you should be able to smoke inside. You admit that someone will have to complain before the cops show up. In order for them to complain you'ld have to be smoking in a dwelling where the smoke wasn't contained. After this law if you're smoking in a dwelling where the smoke is contained nobody will smell the smoke. If nobody smells the smoke, nobody will call the cops. If nobody calls the cops your ass is free to kill yourself how you see fit.

    I love it. Its about dammmn time. I have to smell that stupid bitchs smoke from next door but I cant say anything. but if I play loud music, the law is there to protect her. I LOVE CALIFORNIA and its anti smoking stance.

    i didn't insinuate a fire couldn't be started from a cigarette... i pointed out that many commonplace things in the home can, and do, cause fires - thus negating the logic to one poster's attack on me.. i also have not resorted to cursing...

    But it's like anything else. I can film hardcore porn in my apartment and violate a noise ordinance, but it's only an issue if my neighbor actually complains. For the examples you give of a contained HVAC situation, if no one can smell or KNOWS you're smoking, it's not an issue. I'm sure you occasionally go over the speed limit, but unless someone calls 911 to complain about your driving or a cop spots you, it's not an issue.

    It's only really going to be an issue in places where someone can actually smell the smoke from adjoining residences. Otherwise, how would anyone know?
