In most places, arguing on the side of the road ends in towing and storage fees plus some time downtown

HI must be struggling financially too to write such a cheap ass ticket.

damn u got one of the punk ass cops! it's worth fighting though considering you do have flaps and the tires don't stick out that much as he said it does. I had a super illegal 86 pickup and never been bothered even when driving next to, in front of, or behind book em. My uncle used to own the truck for years before I bought it off him and he also never got ticketed. One of my friends had a Taco similar to yours and he got pulled over a couple times. Maybe they hunt nice trucks only :D

    BTW recon is fucken retarded

LOL..... The funny part was when i drove off...

He was still kinda talking, took my stuff back rolled up the windows while he was finishing what he was saying, and drove off while he was almost still standing by the drivers door lol.. then stopped to talk to the guy picking up the carts and blocked the cop from leaving then drove away really fast in the parking lot, stopped at the stop sign, put the blinker on counted to 5 and then went LOL.. he knew I was pissed....

Last words i said to him as "I will see you in court"

See this is how I feel.. I believe there are plenty of other things they could be doing.. This just waists time.... and this crap is what gives cops a bad name.....

We deal with officers all of the time at work.. I treat all of them so very well, I expect the same when pulled over "or" from the moment they see me, to decide to pull me over or not.....

Its like speeding, ya people should get a ticket , but there is a time and place to do it and if your going like 45 in a 40zone, does that deserve a ticket? Prob not, however 45 in a 40 zone with tons of people close to the road, ya should prob slow down a bit ://.....

Are you required to have flaps on all 4 wheels? Looks like the fronts are missing in your picture.

In my Pathfinder I was pulled over for "failure to obey a properly placed traffic control device" (proper being debatable) and when the popo was walking to my driver side window I saw her pause and line up my tires with my fender from directly behind...good thing the Pathfinder had them aligned perfectly...

From the HI Vehicle Code: [§286-202.8] Mudguards; protective devices. (a)A commercial motor vehicle shall not be operated on the public highways unless the vehicle is equipped with fenders, covers, or other devices, including flaps or splash aprons, to minimize the spray or splash of water or mud to the rear of the vehicle. (b) Violation of this section shall be subject to a fine of $50, notwithstanding section 286-206. [L 2005, c 134, pt of §1]

It looks like it is going to come down to whether or not the court (judge) can be convinced that the factory flaps at the rear of your truck are adequate and also that you don't need the flaps on the front tires. If your tires extend beyond the fender line, and they are not factory size tires, you might not win this in court.

You will have a stronger case if you can show that the tires on the truck are the same size as when the truck came from the dealership. If you've installed wide/taller tires, it may not help your argument.

I don't know if pick-ups are registered with commercial plates in HI as they are in CA. If they are registered with a non-commercial plate, this section applies to "...commercial motor vehicles..." There may also be another section(s) that I haven't been able to find that apply to your vehicle. If you can scan/copy both side of the ticket, I might be able to do some research for you.

The CA law is much more specific:

27600. No person shall operate any motor vehicle having three or more wheels, any trailer, or semitrailer unless equipped with fenders, covers, or devices, including flaps or splash aprons, or unless the body of the vehicle or attachments thereto afford adequate protection to effectively minimize the spray or splash of water or mud to the rear of the vehicle and all such equipment or such body or attachments thereto shall be at least as wide as the tire tread. This section does not apply to those vehicles exempt from registration, trailers and semitrailers having an unladen weight of under 1,500 pounds, or any vehicles manufactured and first registered prior to January 1, 1971, having an unladen weight of under 1,500 pounds.

    Good luck,

    Ray

I can't tell from the pic, but do you have flaps on the front? Pretty sure you'd have to have all 4.
