Wow those cops are strict over in Hawaii. Here in central CA they don't pull people over for hardly anything. I see wanna be monster trocks with wheels sticking out into the next lane drive right by CHPs and they don't care. This new side mirrors that look like wings going down the road is the same. They stick out into the next lane. Anything to be an @$$hole, I guess.

Which is why I left the Peoples Republic of California. Too many foolish laws that impede freedom. In Florida, we have better oranges, warmer water and no laws about wheels sticking out or mud flaps.

We agree once again Larry ... we are seeing it from an old guy's point of view ... the OP brought out a little bit more in each post ... I'm tossing the bullshit flag on this ... rolling up the window and driving away while the LEO is still talking ... I'm not buying it ... OP - you're suspect ...

"Yes sir, no sir, I'm sorry sir I wasn't aware of that"

You are dealing with a guy who has the power to completely fuck up the rest of your weekend and potentially cost you $1000 even if you didn't do anything wrong.
You might "win" in court, but you don't get the money back that you paid to the bond guy, and you don't get the money back from the towing and storage of your Taco.

OTOH, in Florida, you can stand on your roof and hit a golf ball into either the Atlantic or the Gulf if you don't top it and can clear the highway overpasses, and if you ride a motorcycle, a weekend ride consists of "Ride 200 miles, turn left, ride 50 miles, turn left, ride 200 miles, turn left, ride 50 miles, you're home."

We've got Palomar, Glendora Ridge, Angeles Crest, Malibu Canyons, etc...

They aren't covered by the fender/flares.

You guys are lucky on the outer islands! No Recon! But it is stated in the safety check regs. that the tires are NOT to protrude from the vehicles fenders. They just don't enforce it on the other islands.

    I found this.

"[FONT=Times New Roman, Times, serif][SIZE=-1]Section 16-17.31 of the Kaua'i County Code: No person shall operate on any highway any motor vehicle, trailer, or semi-trailer unless equipped with fenders, cover, flares, mud flaps or splash aprons or unless the body of the vehicle covers the width of the tire tread for adequate protection to effectively protect against spray or splash of water, mud, rocks or other debris that could be propelled by the tires."

[SIZE=-1]This does not say the mudflaps need to be the width of the [SIZE=-1]tire" It just says it needs to be effectively protect"

[SIZE=-1]What do you all thin[SIZE=-1]k about thi[SIZE=-1]s? My mud flaps are a little [SIZE=-1]smaller then the tires, but i dont think there are any options to get wider ones that will look [SIZE=-1]factory....

Its really up to the judges. I used to do safety checks...mud flaps are a stock item, so you need it. To me, its adequate. To the leo you didnt have mud flaps at all.

Theres people who get away with murder(or just 3 years). There's people who get caught for weed who go in for 8. Idk man, id fight it anyway.

I think you're going to get boned on this OP. I can't really tell from your pics you posted, because you don't have one taken directly behind the truck, but it looks like your tires stick out more than half and inch past those flaps to me.

I doubt the judge is going to let you off on a technicality, like the cop checking the box that says "no flaps" instead of "inadequate flaps". If I were you I'd toss the factory flaps and get some "nekkid lady" trucker flaps, pay the ticket and go on with life.

The judge isnt going to see the truck unless op brings pictures of it to court or mail it in. The truck is considered safe and he didnt illegally remove the mud flaps. If he really wants, he should go to the dealer and have them write a letter and provide pics that his truck is indeed following the law by having the stock item on the truck and it isnt removed. Replacing those mud flaps would work too, but why do that when hes following the law already?
The only thing the cop, county of Kauai and State of Hawaii can say is the truck is modified and until he proves the altered height is safe they can put a stopper on the registration and take your license plates. I doubt that will happen...but fighting it and telling the judge there was indeed mud flaps on your truck, and according to PMVIs, you are required to have it. It came stock and modifying the stock equipment may void warranty and possibly wont pass a PMVI.

True, but all the cop has to do is say they are inadequate, and that's what he meant to write it up as. Cops word is gold in court. Unless OP can get the cop to admit he's wrong.....good luck with that.
