Speeding ticket in Vermont - fight or not?

    Does your truck have stock sized tires, or larger? Larger tires could account for the difference in the 59mph your speedo was reading, and the 61mph you were clocked at. OK, razzing on the 59mph part, but since you said you weren't doing as fast as 60, I hear 59. Without proof otherwise, I think a judge would think the same.

    Is there a difference in the ticket between speeding at say 10mph over, and the ticket you got?

    Okay, so here if the cop doesn't show up you win. Case dismissed. If he does show you have to prove beyond a reasonable doubt that there was something wrong with him issuing the ticket. Did he show you the reading on the radar gun? Probably not, who asks anyway.

    Partially valid question, what town was it? Curious since some towns/cops are better at showing up than others. THere's 3 cops in my area, love writing tickets, hate showing up to court. I got out of my only speeding ticket that way.

    You can definitely fight it, might go well, might not. It's a gamble but sometimes it pays off.

    did the cop show your the radar?

    here in canada if the cop didn't show you the radar showing how fast you were going then you can use that in court and sometimes it will work and you get off free

    Doesn't need to...if u know you were in violation pay the consequences. He didnt cite you for other infractions. End of the day, as long as the officers radar/laser has been certified, training is still current it's his word vs yours.

    In some states and/or insurance companies ... any speeding more than "20 MPH over posted speed" limit gets extra points/costs.

    If that is the case ... then fight to get it lowered 2 MPH (to reduce points/costs) ... if not the case ... just pay it.

    This is the best way. If the ADA refuses to reduce the ticket to a non-moving violation, fight it out in trial, especially if you have a clean driving record.

    But in California, he'd get a ticket for BURNING wood.

    Varies from state to state.
    In California, part of radar qualification is being able to visually estimate speed within 5mph. The radar is simply a confirmation of the officer's observations, just as the FST and blood/breath/urine test is a confirmation of observation and is not required for a DUI conviction.

    Remember the old (time & distance) VASCAR by Federal (to check speeders) ?? It was all visual & is still used by aircraft.

    Oh yea. Forgot about the firewood. Usually the other way around though. My fiance is from Worcester. Any chance of the Asian Longhorn Beetle coming up here and killing our Maple trees is usually met by an armed posse at the border. Just saying. Forgo the firewood.

    Lots of good replies here. The cop only had radar to go on because it was night and he was parked around a corner, so no way he could have visually estimated my speed.

    I'm get a yearly wage so taking a sick day won't reduce my pay, but you are right saying a truck load of wood isn't worth $60, I hadn't really thought of it like that.

    And when did it become illegal to transport wood across state lines? Can somebody verify this?
